Writing a Will in India
My wife and I are UK expats living in Mumbai.
Someone told me that I must write a will in India, because if I unexpectedly drop down dead here, then the disposal of my property back in the UK would be governed by Indian law, not by UK law.
Seems odd! Has anyone else looked into this? Do I have have to literally write a new will, or should I just get my UK will notarised here?
Obviously I will also take qualified legal advice, but I'd nevertheless appreciate hearing of forum members' experience or views - or hearing any advice that you're been given. That way I'll know what questions to ask and be better prepared.
Part of the problem is of course that an Indian lawyer may not be qualified to tell me what would happen under English law and vice versa. Maybe there are some dual-qualified people.

I would think that since you are UK citizens, getting a UK lawyer to draw a will for your UK assets should work.

ANd I was told, by a senior (and expensive) Indian lawyer that I can't make a will disposing of property held in the UK, in India. I don't think he is right. I don't think what you heard is right either! If you drop dead, intestate, anywhere, you leave a mess, and possibly and expensive one, for others to sort out. At the very least, make a simple will leaving all your property to your wife/children/etc. Remember that it can be torn up any time in the future, when you have sorted out the list of charitable organisations you are going to endow with your vast fortune!
