Baby born in India inquiry

Hi,

I have a question I would like to ask.

An Indian citizen with an Austrlian PR and his Australian citizen wife go to India to live. They have all the papers done for this and their 2 year old Australian born child.

If she has a baby in India what are the legal ramifications for it to become an Australian citizen the same as she and her first child is?

As a child born in India to parents (atleast one) of whom is an Indian citizen, the child is automatically an Indian citizen by birth. However you can choose to get the child Australian citizenship by approaching their consulate who will issue an Australian Passport. Because India does not allow dual citizenship, once the child receives Australian passport, (s)he can not get Indian citizenship.

Once the child becomes an adult he/she can claim back and get Indian citizenship if he/she chooses, by giving up the Australian citizenship.
