US Citizen living in India wants to marry Indian Citizen continue to live India

I am a US born US Citizen and but came to India when I was 10 years old. Since then I am living in India. Now, I am 24 years and going to marry an Indian Citizen in India. Now, I want to continue living in India for few more years. So, after marriage, can I apply for green card for my husband and continue to live in India for few more years. Will his Green card will be valid even if he lives in India for few more years? Can it be renewed even if we never go to US for few years? Can my husband get US Citizen after 5 years of green card, even he is living in India with me? Basically, can he get US Citizen when we still live in India? Because after marriage we may live in India for few years, then go back to USA. Please tell me what should I do?

The Green Card is a permanent residentship in the US. If he is not a permanent resident, how can he be eligible for PR ? You have to be in the US to get one. One enters the POE with the relevant paperwork I guess to begin the process.

Start reading up the FAQs uscis.gov, forums in immihelp.com and about a year before you plan to move back to the US, start the paperwork for his PR.

As a US citizen have you (on adulthood) been filing your annual income tax with IRS ? There are a lot of ancillary issues related to your moving back to US, and your financial ability to support your spouse. If you cannot support him, you need a co-sponsor who can.

You do need to hire a competent lawyer, as none of us have clue as to what US missions in India, and various federal agencies in the US currently require of its citizens who plan to marry and bring over their spouse.


To many of your questions, the probable answer is no.

Smells but just in case...

Books could be written on this topic. If they want to & even if they don't they can make you miserable and a lot of the time its just bureaucratic madness. I am not sure a lawyer automatically helps. In fact, it can run up costs in the thousands on top of the maddening delays. Persistance helps although in my case I gave up after the fourth time the paperwork was lost and called my mother for sympathy. What really helps is if your Mom dated the chair of the INS subcommittee in Congress, done. Same sex or doubtful circumstances are a whole 'nother kettle of fish (apologies to Mach for the colloquialism)..
