I am confused or rather drunk but, you are in an EU country, are you not ? So, you will get a legit marriage certificate, right ? India has a mission in Nicosia, right ? Would they not be the best source to answer your questions ?

Or are you asking if you can finis a 7NT without confirming whether you and your partner have all four aces and kings ?**

[** Meaning there is something that is not obvious to us, and you have your own doubts]

I was about to reply to your original post, which made it seem like a straightforward case. But, if you have an overstay in Cyprus, this can possibly complicate matters.

I am not sure what the marriage laws in Cyprus are, but since you have overstayed, they may not let you two get married, even after Croatia becomes a part of the EU. Before letting you marry, you might be asked to resolve your overstay issue, which might involve a trip to India anyhow.

For this reason alone, I recommend that you first check if you will be allowed to marry in Cyprus without resolving the overstay issue. If yes, then things are not too complicated. If no, then you might have to consider alternate marriage arrangements.

The marriage certificate issued in Cyprus will be valid everywhere in the world, but you must get it properly legalized. This will almost certainly mean at least an apostille on the marriage certificate.

With the marriage certificate in hand, theoretically, none of the EU countries can deny you a visa to visit their territory, as per requirements of EU directive 2004/38/EC. But, the implementation of this law can change from country to country, and as such, it would be best for you to contact the Croatian consulate to check what you will need to obtain a visa after marriage to a Croatian citizen.

Damn !!! Old age dementia must be setting in Did'nt you ask this question a few months ago ? Lucky 'O Lucky Oey You are not living in Cyprus, you are merely on a tourist/visitor's visa right ? If you have not yet gone above your visa expiry; get out ASAP, even if you have exceeded, get out still. Why risk it ? I don't know about EU or Croats, but Americans would put a normative 10 year bar on entry.

While each case of visa, or overstay, is unique and is evaluated on its own merit; there is a normative bayesian heuristics that factors in every decision; and that is - People from pind are more likely to overstay and be in visa violations in many countries in that part of the geography.

If he gets married to an EU national, they cannot kick him out or deny entry. Then he falls in to this special crack in the system. He may have to leave to get a visa that allows him to live there, but he cannot be denied it any longer. Isn't the EU wonderful at times?

Btw, nycank, love that post!

If court marriage, then probably it will be valid in India. In Croatian Embassy they'll ask for apostilled marriage certificate, without an apostille it's not valid.
If you two are married and you are planning to live in Croatia, you can apply for the temporary stay instead of visa. Your girlfriend can check here the details: http://www.mup.hr/1165.aspx
