In addition to her stupidity in the first place, she has just published on the internet that she tried to smuggle gems out of india and into Australia, why should she be entitled to her money back? If i try to rob a bank, but it goes wrong, can I go to a lawyer and ask to claim the money back on the advance I gave my getaway driver I didnt end up using? come on people????

Jamie -
While you have the world figured out - not everyone might always agree with you. Let's agree to disagree, but please don't go about asserting that anyone believing otherwise is stupid. I know you did not use the word, that's exactly what your tone suggests - and it is not appreciated. |

c'mon Kmalik,
Clearly, an illegal deal gone 'wrong' and you want her to further incriminate herself? by all means, let her talk to a lawyer and decide for herself. But to expect others to empathise with a situation where a little forethought is to be exercised? Damn hard, when people are doing the financial equivalent of Darwin awards of removing themselves from the gene pool. I gather the tone of the words of Jamie was "incredulousness"

Until Chrystal gets back with more information I am not going to put much effort into this.
Here is the Australian legal opinion - go to see a half decent lawyer, use one of the free advice lines or legal centres. DO NOT GO TO THE POLICE IN AUSTRALIA UNTIL YOU DO SO. It is likely from what you have outlined that you may also have committed a crime under Australian law - IGNORE ADVICE TO THE CONTRARY. If you have and if you want to continue to pursue this matter then the solicitor will be able to provide you with appropriate advice for your consideration. YOU NEED LEGAL ADVICE which this forum can't provide. But it is always good to hear about scams to protect others. So you won't get legal advice but you can fill in all the hazy bits and we will listen. Last edited by Dr. Gajaprishthakara : Apr 23rd, 2007 at 23:39. Reason: spelling - always spelling |

btw Since these scams must be well-documented both in India and abroad, I'd expect something of a listening ear for complainants. But better tread carefully, and you have obviously willingly agreed to participate in whatever shady deal. I was thinking assuming that this AU$15,000 would be a small percentual "finder's fee," the actual alleged cargo would have been worth a small fortune, inasmuch as it even existed. If the responses here have seemed a little harsh, imagine what a police enquiry would be like. And btw I do know these guys can be persistent and convincing, so I can sympathize to a degree. It's just a shame the OP didn't heed any of the alarm bells, which appear to have been plentiful all along the way.

Mach - true
except that this is a straight out series (!) of crimes that she has committed on an international level (yes - not high level but...). People who get involved in this should never expect a sympathetic ear. There may be a bit of a deal that can be done to make things a little lighter but people need to recognise and accept when they get into this sort of thing that there are very real risks. There are similarities more here with partners in crime who attempt to seek judicial/police intervention when one of them breaches an agreement. Some sympathy may come from the right Indian authorities but, for the Australian authorities, they would probably say "very interesting - here's your penalty, idiot" (no offense to OP). This is just not a situation where 'breaking a syndicate' would protect the innocent as there are no innocents to protect. |

As a tangent 'ignorance of the law is still not an excuse'. Pretending to say 'I didn't know' is ALSO not going to help.

If the shipment had any value and was delivered it would be in the US. However, if past patterns hold the actual rocks even when delivered are semi-precious and well below the import value levels and and in this case seem not to have even been delivered. Not wanting to be a shade tree lawyer but I see no crime on the OP's part..

it's funny that this point is being challenged at all; aren't all cons a matter of making the "victim" implicit with the crime?
