Help needed, bought something, did not get the goods

Hello Guys,

i actually don't know if I'm right here. Heres my Problem, hopefully you can help to solve it.
I was in India for six Weeks, in the second last Week i was at a taylor to make a suit. Unfortunatelly i had to ask him to send it to another place in India, because i had to go there.
He sent it via courier, but the parcel did not arrive, it was a mistake by the courier.
Now my problem, I'm back in Germany and the Taylor offers me to send the stuff to me, but now i shall pay the half extra charge, the other half pays the courier (20).

The guy promised several times it will be no problem, but now its a problem. Do i have to pay or is there an law in india, what says who has to pay for delivery of goods?

I'm pretty pissed of, in India i had to phone him, the courier and so on it was my money, my time. What are his duties?

Hopefully you can understand my problem and maybe even help.

My Gawd! Was the remote delivery apart of the original negotiation ... or was it more of a last minute & desperate requirement? Did you organize the intra-India courier & shipping details .... or did they?

From what you have written, it seems the tailor is doing what he can to get the suit to you.
The tailor sending the suit to another location was never originally agreed to, so his duty is just to tailor the suit and hand over to you, but he did send and the courier messed up. Hopefully the courier returned the package to the sender.

Now the tailor is offering to send the suit to Germany which is again way beyond what one can expect. If he is asking for half of the cost to courier (as i understand it), I don't think it is unfair at all.

Have you already paid the full cost of the suit+tailoring?

Hello,

the delivery was part of the deal. I paid tailoring and the failed shipment. So it was part of the deal to do the tailoring and the shipment to me.
Because i was unsure, if the parcel will arrive while i am in india he offered to send it then to Germany. If he had not made promises that the suit will arrive at my stay 3 days after etc i never accepted that deal.

That will never happen again. I wont order anything with shipment in India.

There is a big difference between national and international delivery charges.

It seems tough, but imagine it the other way around: a courier fails to deliver something to your address in Germany (couriers are far from perfect); you tell them to deliver to a different address. Fair enough: they've been paid to deliver to you. You tell them to deliver to an address on the other side of the world? Whoa! That wasn't the contract in the first place.

You've got an offer to get it shipped to you for half the cost of shipping: I'd go for it.

If you get the items tell us what the quality of the Tailor's job was. A reference either way is always useful..

How I look at it -

You wanted the parcel delivered in India at a reasonable courier price.

The above plan messed up and you have 2 options

A - Work it out with the Tailor to get this delivered to Germany.
B- Forget the whole purchase
C- Ask some Acquaintance to collect on your behalf or ask the tailor to courier it to them.

Assuming the tailor is already paid for his labour below is my take.
  • If you think the cost of the whole courier to Germany is worth what you bought and got tailored, then go for it. As long as you know the tailor is reknowned and trustworthy.
  • If you think its not worth the hassle just ask him to keep it with him and you will be back in a few months. I dont think he will followup with overseas calls after a few months. Understand even if not much it still is an expense to him to call you up and followup.
  • If possible try to figure out the option C this will suit all of the parties involved.

Take option B unless you paid a lot of money and are convinced the suit will be good quality. If he sends it to you, you'll have to pay customs duties and VAT (MwSt, 19%) on it and pay the courier for filing the customs declaration on your behalf.

You made 2 errors with this deal:
a) having it shipped out to you instead of getting it at his shop
b) (presumably) having paid everything in advance

Cut your losses, walk away.

Hi akasniffer,

I think you should just forget about it. Leave it at that.
Or is the suit really expensive and good quality that you really like it? Think it over.
If the tailor sent it to you to Germany in his own expense, then take it, otherwise i'd say leave it. Or do you speak with him and make a proper agreement that you pay half and him half for the post to Germany? that would be acceptable. But if you have to pay the full post to Germany, i'd say not worth the trouble, expense etc.
Even if the price of post is split between you and tailor, i would say, don't pay him untill the suit package reached your hand.
