And we can't seem to keep straight which one we're talking about at any particular time!

As far as I'm aware there's only one definition, and that's defined by RBI under FEMA. There are probably exceptions based on different sections.

I dunno, cyber ... it might work in India, but it sure wouldn't work in the U.S.!

On a more serious note, speaking of U.S. immigration rules, there has been a rash of recent stories here (Northern California) about long-time illegal residents (some of whom didn't even realize they were illegal because they were brought in as children by their parents) who have been sent packing -- just flat out deported -- after living here, sometimes for decades. It's bad enough for the older adults, who at least USED to have ties to wherever they came from, but some of the younger people have no more connection with Guatemala or the Phillipines or wherever than I would if I were forced to move there. Very scary. Very cold.

Yes cheers Anders I agree, you can do it on more than one visa but if you really have no inention of proving yor intention to stay in India then you are still only fulfilling only half of the criteria of residency.

Can I please just clarify one point, I am here to help, sorry if that offends some people but there are actually people in ths world who do not like to see people struggle when they can give a little assistance and guidance for free. It may not be to everyone liking what I say but at least I am having a go. Anyone who takes complete advice from someone on this site without checking it out with a legal eagle must be nuts anyway!! Professional advice in Goa is very limited, I mean it when I say that many advocates will tell you completely different stories. If is a fact, I have been to so many and it is so frustrating. However you must put your trust in at least one as without them you cant do anything. All I would say is you must try get proffessional advice, if one person has been happy with the service they have received off their advocate then go with that, you can always get a second opinion if you dont like what they say as the cost is so reasonable. Just dont walk into any office which says Advocate and expect them to tell you everything you should know thats all.

this is sort of addressed by this, i would think.

the nick has a spouse that is indian but ,as he says, has to get in the queue for each next step. unlike the US, it's not impossible to get what you want in india, it just is a beurocratic queue..and is time consuming.

Residency as a qualification to purchase and own property is defined within FEMA. It is not the same thing as residency in immigration terms.

Whilst "residency" under FEMA qualifies for property ownership, which should then qualify for X-visa and resident permit it does not (as far as I know) work the other way around. I have the visa and the permit, but,I understand, still cannot purchase property withour the FEMA-defined qualification.

trust me on this one. fema and tax residency are different.

fema has a kind of reverse thing... some rules for indians are regulated by "the intention to return to india".. which may be as crazy to figure out as a foreigners intention to live in india.

but thats the way the cookie crumbles.

abraacasa, your input is welcome, and I haven't seen anything in any of your posts even beginning to break any of the forum rules.

Oh, and capt_mahajan... it seems you have mentioned four definitions, includng Jesus . And he's supposed to be burried here (maybe he was waiting for residence status. And waiting. And waiting...)
