Indiamike.com is a discussion forum. It is a place for sharing news, experiences, ideas and opinions.

Some of the contributors here are very well-informed.

No-one makes any guarantee about not being wrong.

Nobody posts here as a profesional, with any responsibility that would incur.

Evrybody here just tries to help.

Seems to me that you have joined IM just to argue one issue and cast petty and sarcastic slurs on everyone else who has something to say about it. If that is what you enjoy, kindly go and do it somewhere else.

We are going to get on with the conversation anyway.

Thanks.
Hey Nick, please don't scare them off. I'm interested in knowing the outcome of different peoples' situations.

Question Computer checks?

I'm told there was a report on Indian national TV yesterday that computer checks are to be run on all foreign property registrations in India.
Can't find anything in any papers at the moment.

mind you, I wasn't aware that it was computerised anyway.

Yeah, that's what I mean. Maybe when they get a computer they're going to put all the properties on it.

There was a power cut when we went for our marriage cert.

Out came the candles.

Didn't notice any fire extinguishers. Or fire escapes, for that matter

I have been reading all your comments for the past week. I have never joined a forum before now. However, I found your posts to be enormously informative and written with the best intentions. No one is expecting such a complicated subject to be clear cut or anyone's interpretations to be without mistakes, everyone has different views. It was my goal to examine other peoples experiences, gather information and research the facts of such advice through various legal and government departments. I thank you all for your invaluable input on such an important subject.
As a foreigner I have resided in India since 1993. I have to say that I can understand why there has to be a crackdown on rules and regulations in Goa. Goan life, culture and values are being eroded. It is necesary that the state government perform "a clean up" before it is too late. No one is against tourism, provided it is the kind of tourism that benefits the area, (whereby here the Arab nations seem to have got the right idea). There is little opposition to Indians from out of state or foreigners buying property, spending short or long periods of time. Oppositon is against those that choose to exploit Goa with drugs, prostitution, rave parties and illegal arms, Mafia groups that purchase huge chunks of land in order to solidify illegal activities at the expense of the locals. If allowed to go unchecked.. why would anyone want to relocate and buy property in Goa? Goa requires residents that are willing to contribute and improve the Goan way of life. Do not be misguided, Goan's want to protect the family values they hold and this is the real beauty of Goa.I really do not think that scrutiny of property will exclude these people that can genuinely make Goa a better place to live.
Wish you all a great weekend.

Q.54 Does Reserve Bank determine the residential status of a person for the purpose of acquisition of immovable property in India ?

A.54 No. Under FEMA residential status is determined by operation of law. The onus is on an individual to prove his / her residential status if question by any other authority.

Q.55 If a foreign national (except a citizen of Pakistan, Bangladesh, Sri Lanka, Afghanistan, China, Iran, Nepal and Bhutan) is a person resident in India as per the provisions of Section (v) (i)B of the FEMA, 1999 does he require approval of RBI to purchase any immovable property in India ?

A.55 No, he does not require approval from Reserve Bank from FEMA angle. However, approvals if any, required in terms of regulations prescribed by other authorities such as the concerned State Government etc. will have to be obtained by him / her.

Pinkindia, thanks, good post. This more or less sums up what I've been trying to get across. People still need to show intention to stay long term.

Haritha, this is in my post 122. What point are you making please?

Thanks for all your interesting reads too GoanGoanGone. I would hope with so many people interacting in this forum, we will all learn to have a greater understanding...not just about property rights but to realise that today we are fortunate to live in a global environment where we can learn from each other. I was quite upset to read some of the underlying hostility and rascism in earlier posts.
Just out of interest, I have never heard of anyone being requested to give a virginity test before being allowed into the UK...before I get blasted, I am not accusing anyone of lying.. I was just wondering if this was common practice?
