Paresh, somehow I have not got around to making the changes but soon. Thanks for the suggestions.

good article mridula... i'm glad to know that folks are raising a hue and cry about the plagiarizing of photographs.

but i doubt the procedure will halt.
somebody's got to take them newspapers to the cleaners - make a big noise - lots of tv coverage... i think then, them TOI's etc will sit up.
as of now - they must be keeping 500 bucks handy - to pay off every objection they receive.

i guess you just got to keep at it - laagey raho as they say
watermark [ as nick suggested ] in the corner - that should keep them wolves at bay - no?

all the best - keep at them with a battering ram.

Hard to claim "massive damages" unless you are willing to invest. For every Rs. 100,000 that you claim you have to spend about Rs. 8,000 on court fee.

There is an entire culture, in which the concept of copyright is barely recognised, to be changed.

Even in the classical world, only dancers ever seem to make any attempt to safeguard and capitalise on intellectual rights in their perfomance. If anybody tried to pay a fee for performing a composition by a living composer, I suspect the composer would be astonished!

That's interesting to read, and good to know.

Whilst I think they are are cheeky for not offering you at least the going library rate (probably often not that much), I also think it is probably harder to get an apology printed in a newspaper than it is to get money out of them, so well done

i got robbed again my photo from wikipedia is being used in a print ad campaign for magic bricks. I've put up the details here
Been sending them emails past three days without reply. I cant even take this up more seriously cause my exams are on

I have been in this spot numerous times.
Most of the times i have been sweetly surprised that they do accept their fault and put an apology in their next print issue.

But these things are effective only by 2 means

1. Visiting the publication personally and finding out how it happened. Meeting the editor in chief. A call for an appointment helps. be stern and professional but not rude and attacking. I dont feel going personally as waste of time in internet age coz i take this opportunity to market myself too. Also personal discussions (arguments) create more impact.

2. Proving beyond doubt that its your image. Best way to deal with this is carry the original and ask the editor can you pls show your original. If editor says he does not have create pressue by saying i have it right now and i can prove it right away.

In most of the cases i have seen is the images are either got from some outsourced photographer or an amateur inhouse editor. They have very less or poor knowledge about copyright. even if they do have they are not net savvy. As in one of my cases i was arguing with the editor and he said we found the images on google site and not yours. i made him open the site and made him read the copyright notice on google images on top side. He was convinced.

But in general they do respect copyright. Just that the juniors have screwed up or these is some misinformation or miscommunication.
