YOu may consider speaking to the airline. They will just give you the run around.. however if you are persistent, they will apologize.

If you want more than an apology, then you may speak to your lawyer. Most probably they will settle. You most probably will end up with free tickets for a few months.

However, if the publication of the magazine was outsourced, then you are in for a big fight!

Should I Write to the Editor Again?

I was wondering what should I do? This picture of mine was used in the December issue and I agree their January issue must have been in the press by the time we got talking. But now it must be time for the February issue and I have not heard from anyone. Should I wait or should I bother the editor again?

When does an issue goes to the press? Any ideas?

Unless it necessarily contains topical information, quite possibly months before.

But yes, I think you should stay on that editor's back.

Did you receive the payment yet? Has he invited you to submit an invoice?

There is a much larger issue here in that corporations are becoming very casual about stealing imagery from unsuspecting photographers. If the penalty for getting caught is posting a clarification on the source and perhaps a token payment to the original photographer then there's zero incentive for them to change their practices.

It's theft people, plain and simple, and it's hurting the photography industry as a whole.

OP, please do not let these people dictate the terms of your compensation. I'd say it's time to pick your rate, add a large premium, and send them the bill, then pursue your collection options.

There was a really good thread on how one might pursue this on another forum. I'll post the link once their search engine comes back online.

Shakti, thanks for your viewpoint. Yeah, I never even actually discussed compensation. On Monday, I will definitely remember to bring this up.

I agree with Nick and Shakti. It's probably "slipped their mind" or they're hoping you've forgotten or were appeased by their promises. Remember: the squeaky wheel gets the grease!

could you check the copyright agreement of the place where you share your pictures online? i know few site that take copyright of the images that you upload there.

but this looks more like a reporter who just picked the image from the web.

I have been offered Rs 1000 as a compensation whereas they say their normal rate is Rs 500. I have no quarrel with the amount, as I do not earn my living from travel writing/photography. And as I have a packed schedule, I really do not have the inclination to fight this from a legal angle.

But I added this message from Shakti to the mail to the editor-
