Update

I heard from the airline and the editor who handles the work for the airline. I must say they are prompt. I wrote them over on the weekend and by Monday morning (today) I got the reply. The editor says they got the picture from the person who they have attributed it to. According to the editor the person is one of the top travel writers in India. The editor has asked for one week's time to get back to me. So far so good.

At least the person who used your photo as his/her will stop doing it next time.

Ronak thanks a lot for your comment. Here is another update-

I had googled the author to whom the picture was attributed and I wrote a mail to him asking if he had any idea how he got the credit for the picture? I got a reply. He says he was away and an assistant sent the pictures. When one of his was not opening, the assistant simply downloaded a picture from the internet and sent it to the magazine editor that turned out to be mine. He admits there has been a mistake and says he is willing to write to the editor and also pay me out of his own pocket. I agreed to writing to the editor but of course not to paying out of pocket. Looks like the thing will settled quickly? I will now wait to hear from the editor and the airline again.

This situation just screams of opportunism by unscrupulous people. Pretty poor explanations were forwarded if you ask me.

I would be doing far more than demanding a change in image credits. There have been some pretty good threads on DPReview about such situations. Best thing you can do is hit them where it hurts, their pocketbooks.

Captain, I agree it felt to me also that some buck passing is happening. I am waiting to hear what the editor has to say now.

Shakti, thanks for your comment. I would wait and see how the situation develops. As I said, so far so good. Let me see what does the editor and the airline has to say now. I wonder if they have a policy for such situations.

I think you should insist on taking some money. Because with an apology they can cover their mistakes very easily & they can also repeat this things with some other person. If some money is taken at least it will pinch their pocket, whatever extent it may be.

It will be interesting to see what the magazine does, now that the author has admitted that the photo isn't his. The story about the assistant might be true, but I smell a rat. Didn't the author double check what was being sent to the magazine to make sure it was right? And didn't he see it when it was published? Even if the assistant was the one who made the mistake, it's bad form to blame your subordinate. In my line of work, lawyers sometime try to blame their secretaries for mistakes (and sometimes secretaries do make mistakes), but judges tend to react very unfavorably when lawyers try this. The captain is ultimately responsible if the ship runs aground!

This would inspire me to get a little more firm on it yes. Sounds like BS, in short. Or at least that assistant should get fired & get a very non-erotic spanking to boot.

It's really up to you though. None of this is very easy, and it depends on your stakes and so on. I agree that generally every time they get kicked this may help to not let them try to get away with it in the future. But just weigh the pros and cons for yourself.

But a photographer being away and having an assistant googling up some pic then crediting him for it? I mean come on.

ps Let me kindly specify I've let cases pass because it just wasn't worth it. There's no need to make a martyr out of yourself. Again, just weigh your chances and what it's worth to you. But I agree people shouldn't generally be made to think this is acceptable professional behavior.

Thanks a lot for all your replies. I know the story is the usual one, when things go wrong assistants get the blame but th photographer did say that he agrees it was his responsibility after all.

Now I have to wait and see what the editor and the head corporate communications have to say. The ball is in their court. I will wait to hear from them first.
