Case Summary:
I am an Indian citizen by birth. I got married on 8th July 2004 to a Bangladeshi citizen with passport valid till 29th October 2012. Her last date of entry in India is 26th May, 2004. Ever since our marriage (on 8th July 2004), she is staying in India with me and has updated regularly her residential permit for extension of stay on the valid passport.
After marriage she applied for Indian citizenship by virtue of marriage with me, and she was advised to re-apply after completing seven (7) years’ of continuous stay in India after marriage. This has completed on 7th July, 2011 and we are planning to apply for her Indian citizenship by virtue of marriage with me.
What is the proceedings to apply Indian citizenship on marriage ground to an Indian citizen?

When is the correct time to apply for Indian citizenship?
Immediately after getting married / after applying and getting X-visa / after staying for 7 years in India ...

That's what made me confused !!!

Hence the above mentioned situations, where the spouse applied for citizenship just after getting married is wrong !!!

Why should you be confused. It's clear in that link.

Quote:
Persons who are married to a citizen of India and who are ordinarily resident in India for SEVEN YEARS (as mentioned at (a) above) before making application under section 5(1)(c).
...but please study the whole document, forms and any other official material.

One hopes that this is the up-to-date statement.

The only thing that is not clear is the rather major issue of whether Indian citizenship is ever granted in these circumstances, because no-one has come to the forum and said, yes, they qualified, applied, got it, and described their experience.

The information are very clear.

It means the foreign spouse have to wait till 7 years continuous stay to apply for the citizenship ...

Not that, they apply after getting married and X-visa granted ... live in India for 7 years and re-apply !!!
(As was quoted above in the first post)

Yes. People do post stuff here that is just wrong!

(including me!)

So, the experience here is vast, and it is a great resource and source of support --- but one should always consult the official documents.

Right, the second quote sounds more believable, because the wife was planning to apply for citizenship immediately after the seven years was completed. By the way, the documents all say "ordinarily a resident of India" which would include short trips to other countries. Certain other criteria require continuous residence in India for a certain period of time, which would preclude leaving the country briefly during the ticking clock tome.

Sonia Gandhi did get citizenship on the basis of marriage to an Indian. Does anyone have any friends or acquaintances who have done likewise?

So the summary be:

1) The foreign spouse have to live in India on X-visas for seven years and be eligible to apply for citizenship.

2) The passport from the current citizenship needs to be valid till then !!!

3) Even after applying after 7-8 years, no one knows how long it will take to be approved. The passport from the current citizenship needs to be valid till then too !!!

No, the foreign spouse has to live in India on whichever visa is appropriate, such as PIO card, x-visa, employment visa, student visa, etc.

Well, yes. That seems normal.

This is the worst part: how long, or IF it will be approved!
