How to I evict a lessee when the lease is up and the lessee is dead?

How to I evict a lessee when the lease is up and the lessee is dead?

I hope anyone can shed some light on the issue I am facing:

My Grandfather owns some land in Dombili, Maharashtra, which was leased out for 50 years (term on lease).

The original lessee had built a building comprising of both residential and commercial use.

5 years ago, the lessee had sub leased the land (without my knowledge), to a builder, which demolished the original construction and built a new commercial building.

He has about 20 tenants in that building.

Now the original lessee has died, and the lease is finished in Feb 2009.

I want the land back, how can I evict those tenants that are occupying the building, note they are not my tenants or have any contractual rights with me.

Can I just go and change the locks?

Presumably the new building will revert to your ownership, so they may be your tenants after Feb 2009, whether you want them or not. Rather than evicting them, would you be interested in drawing up tenancy agreements from Feb 2009 onwards, or do you want the land back for something else?

This whole thing is likely to be complicated, but maybe there happens to be someone on here who can give you some pointers!

Sounds like a complex and drawn out process. India has some of the worst laws in the world when it comes to evicting tennants.

Hope it works out for you.
