Visa guidance for fiancé

Hey guys,

It has been quite a while since I posted last in the forum, but went through quite a few of the recent posts to see if there was anything pertaining to our situation, however, there isn't anything.

Me and my fiancé live in Germany; I am an Indian national and she is a Romanian/Hungarian dual-citizen. She has been living here for almost 3 years now, with the local address registration proving this.

In July of this year, the two of us are heading up to Denmark to get married there. We chose Denmark since they have one of the least bureaucratic approach to getting married. Besides, documents from Denmark are accepted in Germany without legalization, so that speeds up things for us a bit. Of course, we will get our marriage certificate apostilled so that it is legalized for use in India, Romania and Hungary as well.

Now, here starts the visa confusion for us. We are going to have a reception in India, which is planned for November. However, before this, my fiancé would like to go to India in September for a week so that my family and her can finalize things for November. I have to unfortunately remain back for work.

A regular tourist visa would've been our first choice for the trip, as we have done this every year when we went to visit my family, but September to November doesn't leave 2 months in between the visits.

The second option would be to get the X visa, but we have no idea what the processing time on these is like. We should get our apostilled marriage certificate by second week of August and the ideal travel time for her would be in the second week of September. Do you think this is doable for an X visa? Are there any peculiarities we should be aware of? I understand that we should basically need the apostilled marriage certificate, her pictures and my passport. Please correct me if I am wrong.

Lastly, we have he option of being able to apply for a business visa for her as well. Both her employers and my father's company are willing to give letters for this. Does anyone think this is a wise way out through the situation?

It may also be relevant to know that she currently has a valid tourist visa, which will expire in the beginning of July.

Any suggestions this wonderfully knowledgeable community could give would be helpful.

She is eligible for an Entry (X) visa. She should apply for that based on her marriage to you. Check the documents required.

That is what we really would prefer to do. Do you have any idea as to the processing times these take? I am going to call the Consulate tomorrow to check as well.

I was made to believe by a respected legal-beagle that -

Under Foreigners Marriage Act 1969, you as an Indian citizen can ask to be married by a designated Counsel Officer in the consulate or embassy. That will save you money.

I know some missions advertise this service. Many dont, but under the law, they are required.

Yeah, I heard about it and then asked he Consulate last year. Apparently, they have to respect the local country laws as well and Germany doesn't allow for this. As such, this doesn't work for us.

Sadly, I didn't get time yet to call them due to work commitments, but I will do so soon.
