Over Stay in india

Hi

My mother is a malaysian. She overstayed in india for 15 years. Because my father is a indian. Now she want to back to malaysia. Myself, brothers and mother are born malaysia. We are malaysian except my father because he is an indian. Now i want to know what's procedure to come back to her home country. How much penalty need pay for that. Pls reply. Or else pls send the mail to kaarthi.b@gmail.com

You know that your mother as someone married to an Indian national (I guess your parents are married???) and all children could have easily obtained PIO cards and live legally in India?

One way to get out of India would be getting an exit permit. After 15 years of overstay I have no idea how the officials will react. Good luck!

Shame this has been left 15 YEARS to sort out, that's one hell of an overstay by anyone's standards!

Unfortunately the OP can't apply for PIO cards to regularise the situation, as they are only available in India for those people who have a valid visa.

I would strongly suggest seeing an immigration lawyer, if the OP cannot afford that, their only hope is for the OP to throw themselves on the mercy of the FRRO.

Agreed, a lawyer is your best choice. You should also talk to the Malaysian high commission in India. There are various negotiations between India and Malaysia about the status of workers and people with family in both places. Your question is really an Indian immigration matter, but it's more complex than a simple overstay. We can't really help you on an Indian travel-related website. Talk to a lawyer.

I don't know, but I would suspect the Indian authorities would be as keen as anyone to "regularize" the situation.

So this just may be on your side.

I don't know where to start the procedure. Whether i need to go to the malaysian immigresan or need surrender to the Indian immigration. Pls advice

(with respect to those whose advice looks good to me)

Mach, I've heard about people married to Indians being deprted after 15/20 years living here because of visa probloems. Don't expect anyone official is going to be hospitable.

kaarthi... before you do anything, make sure you are ready to buy that air ticket at a moments notice.

Do you and your mother have a valid unexpired Malaysian passport atleast ?
