OCI Eligibility

I want to establish if I am eligible for OCI. My circumstances are as follows:

1. Both my parents were born in India. My Father's first passport was issued on 16/12/1940 and it was British Indian Passport with a nationality remark of 'British Subject by Birth'. Eventually in the later years he lived and died in the UK with a British Passport nationality status of 'British Subject'.

2. My Mothers first passport was issued on 10/1/1949 with an Indian Passport with a nationality remark of 'Indian by birth - wife of an Indian'. She presently lives in the UK and holds a British Passport similiar to my fathers.

3. I was born in Kenya in 1960, and have held a British passport since birth. I am presently, living in the UK.

4. All my granparents were born and died in India. They never set foot outside of India.

Given these facts, am eligible for an OCI or PIO.

Yes you are eligible.

To prove your eligibility, you will have to provide certain forms of evidence that at least one parent or grandparent was born and resided in India as a permanent resident.

Thanks Haylo,

It transpires from your reply that only my grandparents residential status would be acceptable. (Am I correct here) As they were the only ones born and died in india without leaving India at all. In my grandparents time, they never held any documents whatsoever, therfore how can I overcome this situation.

I think (another one!) that your mother's Indian passport is more than enough.

You could go to the High Commission and make enquiries.

I said "born and resided" not "born, never left and died"

If the applicant or one of the applicant's parents or one of the applicant's grandparents was a citizen of India after January 26, 1950.
