Question Is ECNR required if i do not have a ECR stamp?

Hello,

I recently got my passport and will be traveling to Malaysia in Novemeber. As per the new rules (w.e.f. 1st oct) i need ECNR for traveling to 18 countries in world which includes Malaysia.

My passport does not have a ECR stamp or any other stamp. So does that implies that its ECNR by default? Or do i need to get an ECNR stamp? My travel agent is saying that if there is no stamp then it is implied that it is ECNR. I just want to make sure so that i don't get harrased at the airport.

Thanks.

Does your passport had an ECR stamp when you first got it? I am told that all passports which were issued prior to 2007 had an ECR stamp. This made the people compulsory to get the ECNR stamp to nullify the ECR.

All the new passports (after 2007) does not have an ECR stamp. And i am being told that this means no need to get ECNR stamp since there is no ECR.

Yes the old one did have the ECR stamp hence i need the ECNR stamp on it.

The rule/law might have changed, if your agent is saying so, he might be right.

Aby, Check this link out, Based on that article , I would say that you are good to go. Why don't you contact the passport office and get this doubt sorted out, once and for all?

Happy Trails.

This is what the above site says...

Quote:
Under the Indian Emigration Act, 1983, anybody whose passport is endorsed as an 'emigration check required' (ECR passport) has to obtain emigration clearance (in case of employment visa) or suspension of emigration check requirement (in case of visit visa) from the office of protector of emigrants.
So anybody with an ECR stamp is required to get an ECNR stamp. If there is no ECR stamp then it means that its implied to be ECNR by default.

I will anyhow confirm this with the local passport office.

Thanks everyone.

This is correct. You are good to go. I got my new passports 3 months back (without ECR) and travelled to Malaysia without any problems.

This is what a FAQ on Passport site says:
Quote:
Question 3. I don’t have ECNR stamp in my Passport. Can I get it on the basis of my provisional matriculation or above certificate issued by the University/Board concerned? Ans. We are no longer affixing ECNR stamp in passports. In fact it is not even printed in the new passport booklets. Currently, only ECR stamp is being put in passports if applicant is not eligible for ECNR. However, you are entitled to ECNR status if you possess qualification of Matriculation or above. Even you can get ECNR status on the basis of provisional matriculation certificate if the mark sheets of all semesters of your course are available with you.
