| I'm confused why you're considering delaying registration of your marriage in India, where you apparently plan to live. One issue is that she will not be able to work without an E visa, which requires employer sponsorship and must be applied for from her home country. Once you're married for a year she can apply for a PIO card, which carries residence and employment privileges. Without one of the above options, employment is basically not available, though some have done volunteer work or internships on X visas. There are lots of marriage-to-foreigner threads on the site you should probably review carefully.

| Job in India for Chinese Wife Dear Dilliwala/ other friends, I was going through the thread and have got lot of hope from your posts. I am Bengali and by profession - IT professional. My wife is from Hunan Province of China. She is Electronics Engineer and was working in Shanghai before marriage. We met each other through Internet, fallen in love and got married in 2008. Currently my wife is in X Visa and have Residential permit in India. I am facing problem as I heard that she will not get PIO card and she cannot in India legally. It brings extreme frustation in our life as it is spoling her career (she left her career in China and came here for me) and I know that she is extremely talented. Also her family in China in not affluent and she needs to support them as well. From your post, I understand that with Residential Permit, she can work. If it is not, then I may have to shift to other countries where spouse can work with Dependent visa. It is also difficult for me to permanently shift to some other countries as I am the only son of my aged and ailing parents. Could you please confirm whether she can work with Residential Permit so that I can talk with the private companies (even I can talk with my company) on that ground? Also please inform whether there is any relaxation of rules for PIO card for Chinese citizens. I will be grateful if you can help me to come out from this critical juncture. Awaiting your reply at the earliest. Thanks & Regards, Happyman |

| Sorry... a registration certificate/resident permit does not allow a person to take up employment. |

| Job for Chinese Wife Dear Mike, Thanks for your prompt reply. Dear, please give me some solution/ way out. Else I have no other alternative but try to shift to other countries where she can work. She may not be eligible for govt work, but at least she can do some work (if something happens to me suddenly what will happen to her) and earn some money. If you refer Thread # 29 (Dilliwala's) it is mentioned as follows - And I've said it in this thread too. Anyone with an RP by virtue of marriage to a resident Indian citizen can work, change jobs at will. They can hardly be expected to go 'home' (home is India) to change their employment visa every time. Nor do they go 'home'. Is it not valid? Thanks & Regards, Sobhan |

The people he is talking about are working illegally. Neither an Entry (X) Visa, or registration gives foreigners the right to work in India. Unfortunately as your wife does not qualify for PIO status she will not be able to work in India unless she secures specialist employment from China, and applies for an employment visa from there.

| I do recall that conversation, and that I disagreed with much of what Dilliwala said on visas. I'm not a professional. Ultimately, it is not going to matter what any of us here say: it is what the guys at FRRO (Immigration Office) say that is going to count. I don't think it is kind to give you any false hope, but you could go and talk to them. It is a dreadful thing when international relationships interfere with personal and family affairs, but it is a sad fact of life that they do. At least your wife has a long-term visa and a resident permit, and you are able to live together here. |

| Happyman, as you're new to the site, you may not have reviewed this thread: Foreigners on business visa must leave India! You should probably look it over, as the recent tightening up on Business and Employment visas was in part due to some rampant abuse by Chinese nationals or the Chinese companies sponsoring them. Consequently there MAY be some additional considerations or concerns on the part of the FRRO. As Nick suggested, do give it a try, but the above thread could help you to anticipate some of the possible obstacles. Good luck. |

If they don't want to confer PIO rights to Chinese, automatically upon marriage to an Indian, I could perhaps understand their apprehensions. Do the necessary checks, do all you want but don't destroy lives. I feel for you happyman and I hope things work out for you. On the other hand, would I be so outraged if a Pakistani was involved? I don't know.

| Your best bet is to get a hellaofa good lawyer from Sueidwee Dewey Skruem & Howe LLP - someone who is willing to work for peanuts, who is willing to turn some stones and make it a PIL or nautanki all the way to SCI.

Your wife will definitely not be able to get a PIO card anytime soon or in the future I guess. To work in india, the company in india needs to issue an employment letter and another letter stating why she is being chosen instead of indians, then she needs to take it to the embassy of india in china, then get a work visa and come to india for the job. I know it sucks, but there is no way out. BTW, what was the process involved for getting your marriage registered in India and in China? What are the paperworks you had to do in india and China? How long did the process take in either countries? How long is the X-visa and residents permit valid for? Does she have to renew it back in china every year or can she get it done at the FRRO? Take care, bozzom13
