Hubby on tourist visa - can he go home, change to an entry visa and come back?

I'm here on a business visa and my hubby came on a tourist visa. His visa expires soon and it says he can't come back for two months.

I've just found out there is an entry visa available for spouses of those on business visa. Can we apply for one of those while still in India? If he goes home and applies will the two month exclusion still apply?

I'm disabled and panicking as I would struggle to cope without him here.

Well, the bad news is that you cannot convert a tourist visa into an entry visa in India.

The good news is that if he goes back home and is able to get an entry visa, then the "2 month out" rule should not apply - he can come back as soon as he gets the visa.

Make sure he has all the necessary paperwok though - entry visas are not as easy to come by as they once were, and, whilst he is entitled to one, he will need to explain that he is a spouse of someone who is already in India, so he may need copies of all your paperwork too to prove this.
