When we married my husband got his parents to get a fancy affidavit made about his never been married status but in the end we never needed it. It is still sitting in its fancy envelope

Hi everyone, sorry for the misunderstanding. I should've stated earlier that I'm a FEMALE Australian citizen wanting to marry my Indian fiance in India. We don't really care whether we marry in India or Australia. I'd actually prefer to marry in Australia but after doing some research on the website www.immi.gov.au we decided it'd be easier for us to marry in India.
If we want to marry in Australia we have to apply for a Prospective marriage visa, and to do that I have to be able to sponsor my fiance financially. At the moment due to my circumstances I'm not able to sponsor him financially. As a result, we have decided to marry in India because I'm allowed to marry on my tourist visa, unlike in Australia where marrying on my fiance's tourist visa would be a risk not worth taking. I don't want him to get into trouble with immigration for having the wrong visa. |

hello - I am going to get married (all being well) in North Kerala in June. The registry office kind of made a fuss about me being a foreigner and stuff and they are not really up on the full proceadures because they dont marry many foreigners.
They made me do everything through an advocate and using the advocate they requested an extra fee of 1000 rupees for the service of marrying me as a foreginer. This isn't a legal thing but without paying that money I'd have probalby had to wait a long time for my marriage. So yes you can get married in Kerala but it may take some negotiations depending on the skill, knowledge and honesty of the registry officer you are dealing with. Best if your parnter goes in in advance to clear everything and find out full details. i only had to give my embassy address - not give any other paper but that will depend on the individual office.If you come up with big problems in India Sri Lanka is an easy option.... My Indian fiance went to a registry office in Trivandrum last week to see what we need to do. He told me it's a simple process. All they want me to bring to show them is my Australian passport, my birth certificate and my divorce papers. They said there is no need for me to bring a 'No Record Of Marriage' form or a 'No Impediment' form. If they need any special forms we can get them from the Australian Consulate. They also mentioned what I already knew about having to be residents of the area for 30 days. They said we can prove our residency by contacting the local police station. After we have been residents for 30 days, a notice of our future marriage is advertised for 30 days. The whole process will take about 60 days before we can marry.

thanks for update Jayana - it also sounds pretty straightforward now. Just last night I was speaking to a girl who was married the same way as you are doing in Pune. It was very simple for them she said, and they did much as you have stated in your post.

My fiance and I just applied for marriage on the 23rd of May. All we had to bring and supply to the marriage registrar was Rs 100, copies of my passport, copy of my 'no-objection certificate' from the US embassy and my divorce papers. It was all very simple, and now...we have a marriage date of 25 June
. Although we got a very nice registrar, who had already dealt with an international marriage. I have only been in India since 6 May, but applied about 2 1/2 weeks later. Although my fiance has resided in the same area for about 12 years. ![]() |

hi jayana.im in the same situation but worse. Indian, 28 and aussie divorced fiance- 38. wondering if i can send you a pm to tell you about my case and get some more inputs from you

I have read your previous posts Doloris and I'm very sorry for the difficult situation you are in. Unfortunately, I don't really have much advice to give you. You should try and find as much information as you can on the website www.immi.gov.au. My fiance and I were thinking about marrying in Australia on his tourist visa, but in the end we decided it would be too risky. I spoke to several different people at the Immigration Department, and even though they said we can marry on my fiance's tourist visa, they made it very clear that it is better for my fiance to apply for the Prospective marriage visa because his intent is to come to Australia to marry me. I asked if there was anyway I could make sure my fiance wouldn't get into trouble if he told Immigration on his arrival that he was going to marry on his tourist visa, and they said they couldn't give me any guarantees he wouldn't get into trouble. They said he'd need to have really strong evidence that he was going to return to India before his tourist visa expires. My advice to you Doloris would be DON'T marry in Australia on your tourist visa. If you want to marry in Australia you should apply for the Prospective Marriage Visa. There are certain conditions that have to be met with the Prospective Marriage Visa. Your fiance will need to be able to sponsor you financially. The Prospective Marriage Visa is not an option for me. Marrying in India is easier for my fiance and I. At this stage we don't know when that will be, mainly because of financial reasons. We've only had 6 weeks in person since we met in 2006. I can understand how hard it is to be a part from the one you love. If you marry in Australia on the Prospective Marriage Visa, it is valid for 9 months. After the marriage you can apply within Australia for a spouse visa. If you marry in Australia on a tourist visa (not advisable), you will have to go back to India and apply for the spouse visa outside Australia. You should look at that website I gave you, it's very helpful. You should also get your fiance to do some research too. |

So did you eventually get your marriage registered here? I just married an Indian man, I am Australian, but we had it registered in Melb first and then had a ceremony here. The immigration is complicated here. ![]() |

Well, so sailors say, meaning that the right knot is worth far more than some complex tangle, and one marriage should be enough for the whole world! If your marriage is registered abroad, there is no need to register it again in India. People of mixed marriages may choose to go through more than one religious ceremony, but even that is of dubious legal standing. Immigration into India for the non-Indian partner?
