Help ! Indian employment visa question
Hi Everyone,
You have always had all the answers for my travels, I hope you can answer this one. The Undertaking paper that has to be signed by the employer, It says at the botton "Seal:" What dose that mean??? I think I have all the papers in order, but am confused about that. I don't have much time before I leave. Should I just apply for a tourist visa now and then reapply when I get there??Any other wise words on this process?? Thanks |

Are you referring to the L1 visa to USA? As long as you have the L1 stuck in your passport, you are OK. They seldom ask to see the 'undertaking' doc (but you are supposed to carry it with you. The 'seal' is a wax impression - mine did not have one. As long as it's signed, you are OK.

Ah sorry - I expect the 'seal' is the same thing though, but I do not know in this case.
Why not take all of your documents to your nearest Indian High Commission? They should be able to advise you whether everything is in order. Mods: The title of this thread is misleading and should be edited so that the right people are attracted to it to answer it. The thread refers to Indian empoyment visa, not US! |

Seal, traditionally wax, yes, more recently a stick-on red circle with an embossed impression made ---but a rubber stamp will do.

The employer. They should put their rubber stamp by the signature.
Even if they have never employed a foreigner before they should have a good idea how these things work here! |

Definitely get your employment visa before you come - i came to india on a tourist visa direct from my previous job (also in Asia) when my job here was confirmed. There was no way to get the correct visa so I had to go to the UK (I am UK citizen)to get the employment visa as it can not be converted here. (I had gone to Delhi to attend a friend's wedding and had to go straight then to the UK to get the right visa, so you can imagine the look on my family's faces when I appeared on the doorstep on christmas eve in open toed sandals, coton clothes and no coatand with a suitacase full of sparkly saris!!)
Now i have a question to add......My contract here in India, has just been extended (yay!) and my first trip to look at the renewal options seems to show that additional papers are now needed, particularly to demonstrate that it has not been possible to recruit an Indian national for the position - has anyone heard if this is also required when applying for the employment visa while in your own country? I am thinking that perhaps it is quicker and easier to head back for a quick holiday and renew the employment visa then. Any updates, suggestions from recent experiences? thanks and good luck larki55 |

IIRC a member reported a couple of months ago that her husband was refused an employent visa on the grounds that someone local could be employed.

All I sent to get my employment visa was a copy of the contract with the company (and yes it was stamped with the company's seal, at the bottom of each page). Also I sent a brief letter that I wrote myself explaining my situation, there was no letter from the company, although I guess the contract played that role.
Definitely dont come here on a tourist visa, or else you'll be paying for a ticket back to USA to get an employment one! You also (legally) wont be able to get paid, or, I believe, open a bank account. |

thanks - Nick, you wouldn't happen to know if the refusal was from an overseas Indian embassy or through FRRO/immigration in india? (Sorry, I have been unable to locate the original thread)
mairangi-vice, could I ask how recent this was and where? In December the process was very quick and straightforward in London - I wonder if the new requirements are applicable from overseas missions... Any insights? |

In case it jogs anyone's memory, the post was, I think by an Indian woman whose foreign husband had been employed as a 'fashion consultant'. They applied to renew his visa, and the employers put down 'hairdresser' --- which was refused, India having lots of hairdressers. I don't even remember if it was a separate thread, or a post on someone else's.
Do not rely on my vague memory --- this is just in case it prompts someone else to remember. Some IMers have amazing memory for the site's content. |

Thanks - this was useful. (and impressive recall for a vague memory!)
We are going to try to go through the renewal process through the FRRO here in Chennai and see how it goes. The list of supporting documents required is staggering! Will post any relevant updates. Larki55 - I hope you got your visa ok by now? |
