hi guys have worked in india for 18 months
came initially with 1 year employment visa returned to london and extended for 6 months tried to extend in hyderabad last week and was told i need to show tax forms for india my company pays me a uk salary and did not deduct any taxes for india i am now in london where they have told me i cant get an extension there i cant go back to india in any way until i have proof of tax paid whilst i worked there can anyone advise if i can pay back tax etc etc please help my partner is in india alone and i miss my fish Mod note: changed thread title from 'help' |

ugh...
AFAIK, your partner can pay taxes on your behalf with a penalty for late payment at the local tax office...She would need your income statements for the period while ou were working here... Also, the UK and India have a treaty to avoid double taxation so If your have already paid UK taxes for these 18 months, you may also be able to get a refund from the UK tax authorities... I am no expert on this matter though so take my advice with a proverbial pinch of salt The Income tax offices are fairly bureaucratic too and I'd recommend hiring the services of a professional tax return filing agent to avoid calculation errors and/or bureaucratic hassles... but no income was shown in india as i was only paid in uk i hope there is a solution out there my employer will be going to tax office monday |

oops, I may be wrong, but I think that is in violation of the taxation treaty...
I hope there should be somekind of a fix for that |

Dunno tax treaty, but my interpretation of the Indian income tax rules as a non expert is that your income has 'accrued' in India, and so you would be liable to pay income tax here. Whehter the tax treaty kicks in or not is a seperate, though connected issue.
Yes, one can pay back taxes with penalties, as abhi says. Penalties can be high, depending on whether it was a admitted mistake found by you or something the tax authorities surfaced during routine or otherwise scrutiny. Get a good tax guy in Hyderabad, for a start. |
