Clarification for pio application needed

Hi I am confused about this part

he/she or either of his/her parents or grand parents or great grand parents was born in and permanently resident in India as defined in the Government of India Act, 1935 and other territories that became part of India thereafter provided neither was at any time a citizens of any of the aforesaid countries (as referred to in 2(b)above; or

my father has an indian passport but has lived in the UK since 1979 does his passport count to validate me as an indian origin? if not im in trouble my grandparents are dead should i use their papers such as birth certificate?

i am a UK born indian.

Yes, it is enough to validate you. You are eligible for an OCI. Why hassle with the PIO.

India does not allow dual nationality with Uk as far as I know.

India does not allow dual nationality at all! That is why OCI is carefuly formulated not to be actual dual nationality: you do not get an Indian passport, you do not become an Indian citizen, you cannot vote in India...

i am filling out the form adn just to calrify

Have you or your parents or grand parents were born and were permanently resident in territories falling in present day India, Pakistan and Bangladesh, as on 30/03/1999. If yes, please give the following details:

what the crap does this mean ? if my father still lives in India currently? He doesn't so I answer no?

I intend to go for the pio because its quicker adn may convert to OCi later. I just hope that the HCI will look at my docs and return them on the same day as my father needs it to travel to INDIA. anyone had experience with the London HCI?

I don't know, I qualify as a spouse! I think that the form has to cover quite a few possibilities, and they are not very good at wording such forms.

Of course not.

Yes, it could be worded better, but as it says "were born and were permanently resident" which is the past tense, it does not matter where your relatives live now. It also includes great grandparents who almost certainly are dead, and who are not resident anywhere!

The application form asks for:

  • Letter from British Home Office confirming Indian origin.Indian passport of parents or grand parents of the applicant.

  • the applicant.Nationality certificates of the applicant and of the parents or grand parents.
  • School or college leaving certificates of the applicant or parents of the applicant.
So, as your document are highly unlikely to be returned before your application is processed, and as your father needs his passport, I suggest you submit evidence other than your father's Indian passport.

yes i think i shall have to do that,

i have picked to choose mine and fathers birth certificate however, my birth certificate does not have my mother or fathers name on it. This will also be a problem I assume?

i guess i have my school and college leaving certificates what exactly does this prove for myself?

Why have you chosen a PIO instead of a OCI ? In an OCI you do not need to submit any passport, just photocopies.

Just curious.

i thought it would be quicker? and was thinking to transfer to oci later, im due to travel Jan 20th provisionally. Also I cannot prove that my father is related to me its not on my birth certificate. i think i will have to delay my departure adn request a full birth certificate.

Is it ? An OCI in the US is in the 30-35 days range, after mailing in the application.

An affidavit sworn by your father might be accepted. You might have to ask about this issue at HCI London; if it is a problem for OCI, I would have thought it would be a problem for PIO too?

I believe that PIO processing is reasonably quick, if the entitlement is clear-cut and well documented. If, for any reason, it is found necessary to refer it to MHA in Delhi, the processing time then becomes indeterminate. Months, not weeks. I seem to remember a case of a member who waited a year.

How does that compare to PIO timeline in the UK? I ask because I live in the US and like nycank, my understanding is getting OCI can be just as fast as PIO. Mine came in around 3.5 weeks or so, which is comparable to my family's PIO.

i have concluded that i will apply for an OCI i have requested a full BC to determine that I am my fathers daughter and will just have to hope that it gets processed quickly.

so i will provide

my passport and birth cert x 2
my fathers passport and birth cert x2
plus photos

plus the form.
