Children Born in India

Hi there, I am an American (Indian Origin) who has been living in India for the last 10 years. I am registered with the local FRRO here and my Visa and papers are all kosher.

I got married 5 years back (Indian Citizen Woman) (Marriage is registered etc.) and we had a baby boy last year. 6 Months back we went to the American Embassy and he was naturalized as an American Citizen with a passport. From here is where the problem starts.

Since he was born here, he does not have his first Visa.The local FRRO says they need orders from the Ministry of Home Affairs Foreign Division, Jaisalmer House Delhi.

I live in Mumbai, and I have been trying to contact the above address to ask them If I need to bring my son. No one seems to have a clue of what his happening out there. If someone has gone through this procedure, please let me know how to get his first indian visa done.

I personally don't have any experience with it yet, our baby is expected in May, will have to get an exit visa for the baby as soon as we get the passport. We have Dutch nationality, and I heard from a German friend that she got the exit visa for her daughter (born in India) from the FRRO without a lot of trouble. Nothing needed to be done in Delhi, but of course, our situation is different, with both parents of foreign nationality.

We applied for a dutch passport for our Indian born girl.
After receiving the passport we one month later we left got a exit permit from the local registration officer at the police station. After some pushing, cause i think most officers have less experience with this so they try to get rid of you. Also a limited extension of stay was granted.
For you i think it is best to go together with your family to the MHA in Delhi. They are more experienced, have authority and are capable to start visa procedures.
In this case seeing your family and having all papers i think they will give a X-visa (entry visa) for your son or at least start the procedure. After receiving the x-visa you can apply for a PIO or maybe even a OCI visa.
It's a big hussle and you need patience when your at the MHA office but i think it's best to go there.

What Hemmie says is right.
Frro can give the exit permit. For visa go to Delhi, cause clear answers you don't get trough phone.
When you go there with the original documents make duplicate copies of all your documents, and passfotos, i think they need at least 6. And of course never leave the original documents.

As far as i experienced you supposed to have a exit permit to go abroad.
Also coming to MHA office in Delhi for visa application they might ask for it.

Even if you have a passport from the country that you are leaving to?

Definitely.


Because if you don't have a valid visa or an exit permit, you might be an illegal immigrant. Thus all the fuss about visa overstaying not being just a matter of being allowed to catch the plane home.

I am in a similar but sightly different situation. I'm a British Citizen, an Indian Resident(OCI), married to an Indian Citizen having 2 minor kids with Indian Passports. I am planning to apply for my kids British Passports but then they would loose their Indian Nationality and would probably have to get their Visas to continue living in India. I was wondering if its really worth the hassle.

Many people choose to get the best of "both worlds" by getting British or American (as appropriate) citizenship for their children, and then applying for PIO or OCI for them.

Maybe it is a sad fact of life, but it is true, that that British passport will get them into Europe and much else of the rest of the world without hanging around visa offices, whereas an Indian one will not. The OCI/PIO takes care of their being able to enter or live in India.

Exit Permit

Hi!
I am in a similar situation as you. I'm Indian and my wife is swedish(PIO card holder). We have a 7 month old girl and we just got her a Swedish Passport 2 days ago. I got in touch with The Ministry of Home affairs in Mumbai and they have asked me to come to Mumbai with all the papers(myself, wife and baby papers) and apply for an exit permit.
The Pune Registration office told me they could not do anything since the baby is born here and does not have a visa.
I forgot to mention that we are going outside India in 2 weeks time and therefore wanted to make sure we don't get sent back from the airport.
Could you tell me how things went for you and if things got sorted out?
