Since his birth certificate and passport have your name as father, you can do better than PIO, and apply for OCI for him.

If both parents are Indian citizen, a minor is eligible for a PIO, however, the other parent is not ! but if the OP has "his married spouse" in the mix, it will become scrambled toast-on-rye with smatlz on top

You're right nycank - the whole "out of wedlock" thing might get CGI's knickers in a knot esp w/ the new wife in the mix.

If 1 parent is a non-Indian citizen, the child is eligible for OCI. If he's going to be living in India, OCI beats PIO so why not go that route.

However, after I wrote my earlier post, I realized CGI might have issues given the Italian lady's not your wife (search the forum for a case not unlike yours circa 2010). But then if they're going to get weirded out, it would also happen w/ PIO.

I have a problem with this phrase. It is so medievally last millennia. As long as the dates do not conflict, the OP should be able to slide through...

pio cards for german children

After a lot of hassle I finally got pio cards for our 2 sons.
I am german, their father is indian, mentioned in their birth certificate and we are not married.
First the indian embassy in berlin refused to accept our application because we are not married and 'It is not possible in india to have children without beeing married'. We decided to give it a try and applied PIO for our 1st son in india and after 3 months we got it.
Now after presenting them the pio card for our 1st child the indian embassy reluctantly accepted our 2nd application.
Funniest thing I heard there was that 'how my partner knew that he was the father of our 2 children since we are not married'?

It seems to be possible but one really has to put their foot down and request them to send the application for clearance to mha in india.

Sri Lilliberlin,
your post is very important!
1a) Where did you apply for PIO in India and how did you get to know that it was ready? Any recommendations? Who or what might be helpful?
1b) What might be the chance in a case where the indian father is not mentioned in the birth certificate?
2) My admiration about the way you deal with the "funniest thing you have heard". Did you give any answer?
3) I have seen a form at a visa agency where both parents of a child born out of wedlock have to document something in front of a notary for getting a PIO card for the child. Did you have to do this?
4) Did they request you to have any german documents being translated through a translator acknowledged by the indian government?
All details could be valuable like gold or even more... You are very welcome to reach me also through: Maya.to4@gmail.com
Your grateful Gangadas

if the father is not mentioned in the birth certificate, one cannot be able to apply for such privilage for child...and the eligibility for getting pio card is from the part of grand parents too,(if they are citizens of india and resides there)
