Hello. I haven't been here for a while and i don't know if this will be seen as i can't see the new thread bit.
I have a question. I am british although my parents are pakistani. I married an indian national and he is still in India. I want to visit my Husband and called the indian Embassy for information on some part of the form. She asked me a few questions and also asked about my origin. I told her that i am a UK citizen but my parents have Pakistani origin but they have been UK citizens for many years. She said that becasue of their previous Pakistani origin i will need to apply using a different form although it states in the web site that UK nationals don't need to do that. I have been to India before and didn;t need to use a different form. Does this sound correct.
A while ago i called for a different reason and the person at the embassy didnt seem that sure of the answer. Surely i can't be a Pakistani national or need to fill out the same form as a pakistani national when i have been in UK all my life, or am i incorrcect?

Do you mean the VFS helpline? If not I'd be interested to know how you got to speak to someone in the Indian High Commission, they don't take visa queries from the public, I reckon it would be easier to get through to Gordon Brown!

I am pretty sure that people of Pakistani descent fill in the ordinary visa application form, the Pakistani one says it's for people with Pakistani passports, and there are places on the ordinary form where you enter nationality of parents.

Still, to save having to worry about which form you print off to write your information on, just use the online application process on the VFS website.

Do bear in mind though, that as someone of Pakistani descent, your visa application will take far longer than the usual 2-3 days, it will probably be around ten days and could be up to 25 working days. Also if you're applying for a tourist visa, you'll only get 3 months single entry instead of the usual six months multiple entry visa. That's politics for you.

Ok. That doesn't seem fair though as my Husband is Indian. Does anyone think i might be refused the visa? I hope not.

Haylo i think it was the Indian consulate. The no was on the web site. Tc

No reason at all to think you'd be refused, it just takes longer to process.

Maybe the Consulates are more helpful about taking visa inquiry calls than the High Commission, who always seem to refer callers to VFS - unless you caught someone on a good day!

Hi! thelastcupcake, I am going through same stuff, Iam British with pakistan origins(parents) married to Indian National... have spoken to vfs, emailed them but they all seem confused as they say you cant apply for PIO, and the visa granted would be for 3 months... I have been to india twice and both time they granted me 3 months single entry visa...

Any update from your side, members pls help...

I couldn't locate it on the UK Indian High Commission website, but on the San Francisco Consulate, they state (emphasis added):

Who is eligible [for PIO]?
"Any person who at any time held an Indian Passport; or he or either of his parents or grand parents was born in or was permanently resident in India as defined in Government of India Act, 1935 and other territories that became part of India thereafter provided neither was at any time a citizen of Afghanistan, Bhutan, China, Nepal, Pakistan and Sri Lanka; or who is a spouse of a citizen of India or a person of Indian origin as mentioned above."

Unfortunately, it appears that you're pretty much out of the running for PIO.

Depends on how "or" is interpreted, which could easily be like this...
Any person who at any time held an Indian Passport; or he or either of his parents or grand parents was born in or was permanently resident in India as defined in Government of India Act, 1935 and other territories that became part of India thereafter provided neither was at any time a citizen of Afghanistan, Bhutan, China, Nepal, Pakistan and Sri Lanka; or [any person] who is a spouse of a citizen of India or a person of Indian origin as mentioned above.
which puts a Pakistani (etc) spouse of an Indian citizen in the running for PIO.

As a native English speaker, following the strict logic of my language, I would favour this interpretation. Indian officials might not.

I too favour that interpretation.

In navbulls other post asking the same question (I do wish people wouldn't do that) I posted a link to the official Indian Immigration department web page which actually lists those three PIO conditions (previous passport, heritage, marriage) as three separate items.

I'm sure one of the moderators will add to this, but is it too much to ask for people to use at least marginally correct English grammar in their posts and not SMS-speak? I'm willing to permit exceptions for those under 14 years old.

I've been around here for five years, and now you tell me that it's an "adult site"!

Must be a whole section I never noticed

I didn't think grammar was a priority here. It is nice to read proper english but at times exceptions should be made. Also people do have other problems in their lives apart from just foucusing on how they are writting their posts.

At the time I wasn't feeling so well. Do we have to start giving reasons to grammatical errors now? Mabey people should write proper but it would also be helpful if members actually answered the actual question at hand. Most people do of course! tc
