Business visa to Employment visa

Hi, this is regarding convertion of business visa to employment visa. My boss is a Korean and he come to India in Business visa for 6 months. whether we can convert this business visa to employment visa in India itsself? and also I want to know whether we can extend the business Visa i.e from 6 months to 1 year or more in India itself?kindly send the reply.

I do know someone who had her business visa changed into an employment visa within India, but it did not stop her from having to go home after 6 mos and get a new employment visa. So the change of visa type was possible, but the extension was not. But for definitive info you'll have to check with the appropriate governmental agency.

I think it would be tough. You're going to have to talk to your local FRRO/Immigration Office...

If you wish to convert into an employment visa, just check on (income) tax angle also.Once the visitor stays in India on employment visa for more than a specified number of days(182days?) then the visitor has to pay the tax on his income earned in India, i suppose.

As someone with very recent experience in attempting to do the same, I understand that the only way to do this is to cancel the business visa by applying for a new (employment) visa. This would involve leaving India and applying (ideally) from country of origin.

I doubt that 'they' would entertain a change in visa type along with an extension as your boss should not have been working in India on a business visa.

The tax implications mentioned by citybell as significant - make sure you check it out (I got E&Y to look at it for me)
