A PIO Application
I have posted questions previosuly and have recieved much appreciated advice and information. Nick, my french boyfriend and I are now officially married and he has been given an X visa. A few more questions please:
1. Does he have to register himself he stays longer than 6 months in India? 2. His X visa expires in August'08, when can he apply for a PIO? 3. How long does the PIO process take? We have been moving houses a little, would that prove a problem when police verification for the PIO happens? 4. what documents would we require? Any advice orinformation would be much appreciated. |

You need to check that his x-visa doesnt carry a max 180 day duration stamp on it....if it does he will need to leave the country for a day in order to get his passport stamped thus allowing re-entry. If it does'nt contain the 180 day restriction i still think he has to register at the FRO office if his stay will exceed 180 days.....check the terms of the visa carefully. He can apply for a PIO even before his x-visa expires....once a PIO is granted they will just stamp cancelled over his x-visa. Moving house should have little or no baring on your PIO application. He will need to produce a copy of mariage certificate along with a photocopy of your Indian Passport and or Birth Certificate. Supply as much info as possible showing and proving your Indian origin backed up by your marriage certificate. The PIO Process is usually quite quick providing you have supplied all relevent info.....usually around 3-4 weeks. Regards, Remy

Passport for Indian Spouse...
Adding my question to this thread - to provide proof of husband being an Indian National is a photocopy of passport sufficient, or should original passport be supplied? Also is the photocopy just of the main stuff and the start of the passport (if photocopy is sufficient) or does the whole passport have to be photocopied?

In general, and, passport included, you should carry originals of all documents submitted, along with photocopies.
Somebody will certify the photocopies that the originals have been seen. Photocopies of the page with the photo, the page with the address, spouses name and so on, (first and last?) are required. If the passport is a replacement, and stamped as such, best to include that page, but no, you do not have to submit any of the other pages. |

Try to go back home for PIO, if you can
If you can apply for the PIO card in France, as opposed to India, it will go much more smoothly. After traveling to Delhi and being advised of the previously-mentioned "policy" that you cannot apply for a PIO until completing one year of marriage, we were also told that 'fast-tracking' the application would mean we'd get it in around 6 months...
We ended up applying in the US, and it took less than 10 days, start to finish. However, it does require the applicant to provide his passport along with all the paperwork, so it's not necessarily feasible to remain in India, yet apply through a non-India location. |

Piper, you said the office in India stated their policy about 1 year of marriage before applying, and then said it only took 10 days when you applied in NY. Did you still complete 1 year of marriage before you applied from the states?
I've been married two months now, and I'm living in India. I would make a trip home to the states if I could apply for a PIO card without waiting the full year (+ processing time). |
