What is penalty for ticketless travel in Indian Rail?

I had booked myself to travel by 13239 by Patna Mathura Exp. on 07/04/12 in 3AC vide PNR # 6108139589 and was alloted a confirmed berth 63 in B2 coach. The train arrives at Kanpur at 01.20 Hrs. & leaves at 01.32 Hrs. So before leaving home I enquired from Railway enquiry No. 139 and got the information that the train was late by 30 mins. Accorndingly, I reached station at 01.30 Hrs but was told that the train has already left.

Since I had to attend an urgent meeting at Mathura on07/04/12, I had to catch another coming train # 12403, which runs from Allahabad to Mathura. I explained the matter to the TTE of the later train who after a lot of No-No asked me to sit on his seat No. 7. Later after the said train started, he came and told me that tehre is only one berth in 2AC but he will make full ticket. When I agreed, he made a receipt for Rs. 1114/= including fare of Rs. 614/= and Rs. 500/= as penality.

I was taken aback by the quantum of penal charges but had to pay as he was not accepting my ticket of another train and had declared me as a ticketless traveller.

Can somebody tell me whether the penailty applied by the TTE was correct or not? if not then I may try to file a refund Case with Railways.

1. Technically, yours was a ticketless travel. Had you got a plain ticket, the penalty would not have applied.

2. The penalty amount is within the stipulated range.

1. When you miss a train, you may contact the Station Master; explain him your situation and if he obliges then he would let you travel by the next available train (After confirming the vacant berth position)
2. Kanpur-Mathura according to official website is 312 kms.
Fare slab for the same is Rs. 546(Base Fare)+30(Superfast charges)+40(Development charges upto 500 km)=Rs. 616/- (Which comes quite close to your described fare)
3. Ticket of a train is not valid in some other train unless approved by Station Master or the Guard.
4. Fine for entering reserved compartment without having any unreserved ticket is Rs. 500/-

5. As per the category of the train, you should have purchased second class/2nd AC unreserved superfast ticket. Then, you would have been liable to pay only the difference in fare+Reservation Charge.

Dipyamanbasu has explaned well. You should have contact station master for this situation. Technically, You were travelling without ticket in another train, so you were fined.

as others have noted, your 'reserved' ticket is no good on other trains. you should have cancelled the tkt, got 50% refund, bought a general ticket & then would have paid the difference + penalty (in this case the penalty would be at the discretion of TTE - if there was availability & he 'upgraded' you, penalty would not be applicable).

i'm impressed that you were given a receipt for the penalty + fare. looks like some TTEs are honest, even if it is expensive for the traveller...

btw, you indicate that the train had scheduled dep time of 0132, but had left before 0130 - are you sure about that, because that is almost impossible to happen...

TrainEnquiry for this run shows it was on time - wonder why you got the wrong impression from 139???
