Cool Sponsors--Business Visa--Starting export business with indian business partner

My Indian business partner is able to issue a letter of sponsorship for a 10 year Indian business visa. I am a U.S. citizen, and I mentioned to my visa expeditor, and he noted that I would need also a letter from a U.S. sponsor company.

I already have a partnership deed for an export company, but the issue here is whether I am able to obtain a 10 year business visa with only an Indian company sponsorship. --As I already hold a 10 year tourist visa it would not be thrilling to have the Business Visa request fail; and on top of that the tourist visa I currently hold cancelled.

Any advice would be helpful on this sponsorship matter; thank you

--Also if any advice can be given in regard to joint-ventures and ways to obtain a visa through them would be appreciated

No; I have not set this post up looking for a sponsor from the United States so much as to have someone explain the exact requirements of this.

---Basically, as many people seem to in this expat forum, I hope to live in India for a longer duration. I also am very interested in local art/silks etc (and really whatever comes about through the experience as a possibility) and providing these to the international market; via contacts and also various ebusiness ideas.

I have been spending the last two hours digging up the old posts on this subject, and what seems best is to somehow obtain an employment visa, (as a business visa appears to still be as shady as working under a T visa as far as financial retribution is concerned)---but I need a business visa to open up a bank account and thus obtain an export permit

--I seem to be missing something here though--yes I believe so---I wish to set up an export company (which is FDI 100% possible) according to the 2004 regulations---and also I very much trust my good friend/ and Indian business partner---and wish him to be involved with me--(he already runs various operations in India (North India, Uttar Pradesh)

So I am looking for a way to use my experience in internet sales/ export/ and a knack for what sells internationally to eventually live here

What are my options, and how should I proceed in this endeavour?

Im kind of at a crossroads here; I don't have a money problem at the moment, and of course maybe it would be better to check out the market more or something of that nature--

But I do not have the motivation to put such effort into such an endeavour without first processing, and figuring out how to go about such things.

My question seems to be a bit everywhere

Is it possible, how long is a standard time frame, what kind of cash needs to be involved to setup a "trading" (import/export) business by a foreigner?

Of course many variations of this are possible;

question #2 (more important one actually)

also--as far as my partnership deed is concerned with the export company me and my Indian business partner have formed; what is the best way to go about registering/creating it in order for me to obtain (as a u.s. citizen) a visa that will allow me to does things legally from India as far as finances are concerned and living.

--maybe I should just check out shaadi.com; that appears to be the easy route at the moment

John.sw has been in India for quite some time on a business visa and I am sure he will be able to give you appropriate instructions on how to go about getting the paperwork completed.

i am an indian, but holding a austrian passport for the past 10 years. I did open a partnership trading firm last year with a couple of other indian friends and it was fairly inexpensive. it was with the same motive of getting indian crafts in the european market. i get multiple entry visas for 3 years and i travel 3/4 times a year to india for a couple of months or so.

Process--

It would probably be a bit different for me though then right? As you had NRI status---how long did the process take? And how exactly do you go about getting approval from the RBI.

The issue I am having at the moment is that I need to obtain a business visa to open a joint bank account before we can apply for our export permit. The company etc is already formed, but I have no U.S. sponsor that seems to be needed to get a 10 year business visa from the indian embassy in new york------

Is there a way to get an employment visa, if you have a partnership that the indian government gives 100% FDI to? Hmmm

Still a bit confused on how is best to proceed in this matter----Because I have heard it seems that even having a business visa does not entitle you to receive any of the profits.....so what visa exactly does one need to be able to accept profits from a business he has with an indian partner? And what is needed to apply for such a document?

Everyone gets to see my mind hitting barriers and following new leads--

make sure you arent gettin paid in india while on a business visa. When the business is finalized, you can then apply for a work permit, again submitting all the usual docs. Let me know if you need more info

--hmm this was noted on indiamikes website

but does such a business allow me to get a work permit...and how to go about getting a work permit for a partnership in india....hmmm

--the ideas continues any suggestions?

--Maybe I should now name this post "how to get a work permit after you form an indian partnership"

Your status is that of a PIO and as such it is easier for you to get a business or employment visa. The author of this thread is not in the same category.

If you are a partner in the business venture then you will not be considered an employee and you won't be able to get an employment visa. Another thing to keep in mind is that employment visas are usually of shorter duration with more restrictions.

Your best option is to make a trip to Mumbai or Delhi and avail of the services of a professional consultant who will for a fee be able to give you an indepth explanation of the advantages and disadvantages of a business visa and an employment visa. He will also be able to give you advice on how to incorporate your company to give you the maximum tax benefits.
