Romanian/ Indian marriage in India - what needs to be done?

Romanian/ Indian marriage in India - what needs to be done?

Hello all,

I need your advice and direction as I am not able to get a straight answer until now.
I am from Romania and my boyfriend lives in India. We know eachother for a lomg time now and after meeting in Romania we decided to get married.
It seems to be less "paper work" to officialize our marriage in India and is our first choice as well to have the officialization there.
Can anyone advice on what documents need to be brought from Romania and also what needs to be done in India for our marriage to be set at the Romanian embassy?
Any advice or directions would be of great help.

You should get married in the country in which you intend to live; it will make dealing with officials and bureaucracy in that country much easier, starting with your husband-to-be's visa, if he does not already have some permanent residency in the country.

That's my view, anyway.

I do not think it is particularly simple for two non-resident foreigners to marry in India. Nor is it particular complex to marry an Indian citizen.

There are quite a few threads giving advice and experience: please search the forum, I'm sure you'll find useful stuff.

Hi Nick,

thank you for your reply.
In fact we do intend to live in India, this is why we also aim for getting married there as well.
My boyfriend is an Indian resident, located in Chennai so tus my question on any advice on which papers need to be worked upon, how long did it take for those wo already pursued same plan.

Are you marrying under the Special Marriage Act (non-religious, mixed religion, register office wedding) or do you intend to have Hindu or Muslim wedding? It makes a difference!

Hi Nick,

well, this is the kind of info i was looking for. If these are the options, we will go for the Special Marriage Act. I am Christian and he is Hindu and we don't plan for a conversion of our religion for now, we will just pursue the legal marriage and then will decide when and how to progress with the religious marriage as well.

A register-office marriage is very unromantic; you can find descriptions on the site, but imagine being married by a cattle auctioneer who doesn't stop selling cattle while he does your wedding! But it is just the legal bit; obviously you can have your own do in whatever way suits.

Your boyfriend should find our the register office for the area that he lives in. He should have been residing there a month.

Then you must give 30 days notice of your intention to marry, which gets put on their noticeboard.

Then you get married!

It is very cheap (just a few rupees) and you do not require any expensive agents or lawyers to add thousands to the cost, although they may try to persuade you that you do.

Send your boyfriend to the register office to enquire what they need. The only possible complexity is providing some document to show that you are single. If divorced, its easy; the divorce papers. Otherwise, if your country does not have some sort of certificate that you are eligible to marry, then you may have to make an affidavit or something.

Thanks once again. It doesnt sound romantic at all indeed, but we are looking for the legal best and fastest way to do this w/o having to trip a douzin of times between India and Roamnia to be able to get amrried.

How about teh Romanian embassy? I thought that might be the place where a foreigner could get married? Do you know anything?

If you are marrying an Indian in India you do it according to Indian law. Your embassy, unless you have to get the marriage registered for Roumanian purposes, doesn't have anything to do with it!

You can get a quick "Registered" Marriage in India and then you could get your marriage certificate registered with the Embassey in New Delhi.

Yes, it only takes a few minutes --- after you've given the 30 days notice, and one of you has satisfied the 30 days residence requirement.

Are you familiar with Rumanian requirements, if any, for marriages in other countries?

If you have been living in India you should know there are ways to Quickly speed up things...I happen to be familiar with the laws in India AND Romania and I know how to work aorund things. There are instances when the 30 Day notice can be worked around...get hold of a lawyer..they dont cost much anyway in India. Romania is a bit more complex...but then again if you live in that country its easy to find a way. The simplest way is if the person is planning to visit India, get a visa go to India and notify the authorities while you are in the country. The usual documents rerquired would be you Passport and possibly a birth certificate (translated in English)>

Now, if you want to get around the "Civil" marriage bit in India and not wait the 30 days, you can get married as a "Hindu" and have the Priest or Organization (EX. Arya Samaj) to issue a Hindu Marriage Certificate (Hindu Act) which is GOOD for India. However to have the marriage legally recognized in Romania you will eventually have to get a "Civil" Marriage certificate as a Hindu Marriage Certificate is not good in Romania.

In some "RARE" Instances you may have to get this "Civila" Marriage certificate "Leagalized" by the Ministry of External Affairs and then By the Romanian Embassey in New Delhi..then presented to the Romanian authorities...in this case INEP (Insitutul National De Evedentza Populatiei) and INEP will issue another document alongside that will be vaild and recognized by Romania...Now your next question would be "why would one want this document from the ROmania Authorities?"..Answer...if the couple plan to move to Romania..then they might need a document that is recognized by Romanian Authorities.....there is lots more to this ...I've just put it in a nutshell...
