New Baby Visa Question

My wife and I have been living in Jaipur for the past 9 months. Our first child is due Sept 1. We will have the baby in Jaipur.

The burning question is: Do we need to leave the country in order to get an Indian Visa for our new child??? We heard opinions going both ways.

Who should be contact to get it 'straight from the horses mouth??'

Your nearest FRO (representative), I suppose: http://immigrationindia.nic.in/ . See their "Contact addresses" link for main offices & their contact info; or note their message that "The field officers in charge of immigration and registration activities at Delhi, Mumbai, Kolkata , Chennai and Amritsar are called Foreigners Regional Registration Officers (FRROs). Apart from the FRROs who look after the immigration/registration functions in the above mentioned five cities, the concerned Districts Superintendents of Police function as Foreigners Registration Officers (FROs) in all the states in the country."

Do a search on old threads, this question has been asked before. An expat member who had their baby in India posted the details of the process.

I don't recall the given answer in detail, but it definitely did not involve leaving India to get a visa for the baby, they had to acquire an exit permit / visa for their baby.

Citizenship by Birth
Any person born in India on or after 26 January 1950 but prior to the commencement of the 1986 Act on 1 July 1987 was a citizen of India by birth. A person born in India on or after 1 July 1987 was a citizen of India if either parent was a citizen of India at the time of the birth. Those born in India on or after 3 December 2004 are considered citizens of India only if both of their parents are citizens of India or if one parent is a citizen of India and the other is not an illegal migrant at the time of their birth.

So I guess you should call your embassy.

Hey Haylo. REALLY appreciate you searching that out for me. My wife and i are both from US. I was just looking through the posts and was not able to find the thread recommended by another member.

Apologies, the link is now fixed. It was to Post 12 of the thread, which is where the discussion starts getting helpful, but as you are both US citizens, you'll find Post 43 is most useful to you.

Final Results

We found out that we did not have to leave the country within 30 days after the birth of our son.

When we get ready to leave the country (in our case 4 months later) we apply for the passport. Upon receiving the passport the US embassy will give us a 30 day stamp that allows us to take our child out of India.

Upon arrival in the States we have to apply for a tourist visa for our child.

Hope this is helpful to others in the future.

Ths is a bit confusing. The US says who can get into US, it has no say in who can get in or out of India!

Baby Visa Correction

Thanks to Nick for catching my mistake.

The Indian government will be the one to issue our 30 day exit stamp for our new son not the US embassy.
