living in india with an indian spouse???
hi all,
i have been working the past couple of years in india on employment visas and also got married in bombay to my beautiful wife!...i recently resigned from my job in order to do the same thing but freelance..i.e..more money! and returned to the uk for a business visa which has been isued but they refused any more than 1year which is going to oblige me to return next year to the uk to renew it....basically as business visas cannot be renewed in india-V IRRITATING! Does anyone have any information on this sort of subject area or experience in this????? also they inform me it will take 5 years until they will grant me an X-visa with the ability to work how i want and for who i want???? any info would be greatly appreciated! cheers greg |

eh?
have you checked into a PIO card? Here's some info PIO Card Good for ten years. Being married to an Indian citizen qualifies you to live/work/own businesses in India. The card is $310 in the US and is good for 10 years. I'm pretty sure the same program is available to UK citizens so you should be set. Let me know what happens since we're about to do the same thing! |

hi thanks for the response but im informed as my marriage is only a few months old i have to wait at leat 1 year before i would become eligible for this and working on a PIO card also doesnt seem to be part of the package, i think additional employment/business visas are required?
maybe slightly diferent rules in the US or i hope that you have been married longer than the 1 year! cheers |

yeah 1 year entry visa is fine it seems but you cannot conduct business on these or gain employment

High Commission of India, London (PIO Cards)
The following is consistent with all the other Indian consulate sites I've been looking at. If you can point me to sources that state anything contrary I'd be very interested to look at them. There is has been no mention of how long you must be married. Basically you have all the same rights as an NRI. The following are eligibility to apply for PIO Card: 1 Who at any time held an Indian passport; or 2 He/she or either of his/her parents or grandparents or great grandparents was born in and permanently resident in India as defined in the Government of India Act, 1935 and other territories that became part of India thereafter provided neither was at any time a citizen of any country as may be specified by the Central Government from time to time; or 3 Who is a spouse of a citizen of India or a person of Indian origin as mentioned above. The various benefits available to a PIO cardholders are: 1. No visa required for visiting India during the period of validity of PIO Card. 2. Exemption from the requirement of registration if stay in India does not exceed 6 months. Should the continuous stay exceed six months, registration will be required within 30 days of the expiry of six months with the concerned Foreigners Registration Officer. (Click Here For Registration Checklist) 3. Parity with non-resident Indians in respect of facilities available to the latter in economic, financial and educational fields. 4. All facilities in the matter of acquisition, holding, transfer and disposal of immovable properties in India except in matters relating to the acquisition of agricultural/plantation properties. 5. Facilities available to children of NRIs for getting admission to educational institutions in India including medical colleges, engineering colleges, Institutes of Technology, Institutes of Management etc. under the general categories. 6. Facilities available under the various housing schemes of LIC, State Governments and other Government agencies. |

From what i know this is correct but NRI'S do not have permision to work in india and im pretty sure you will get same the same response as for a long term X visa it was also the same.
I think they are trying to cover themselves from people who want to abuse the system to stay in india by marrying. maybe its at there discretion so you might get a different response in the US but i think in the UK that is the situation as they have no reason to be difficult with myself having numerous past visas, tourist and employment visas of 1 year plus references from indian companys/marriage certificates..etc but i wish you best of luck and a better response for you both ![]() |

actually that might not be correct and im so confused i think ill give up thinking about it until i need need a new business visa and it comes up again next year.

gregs, you could try this, apply for an extension (1 year or more) 3 months before your business visa expires based on your marriage to an Indian, if it comes through fine you usually end up with a 5 yr residence permit the second time around.
edwardseco, they state you need copies of your passport (if you ever held an indian one) or of either parent's expired/invalid or current indian passport but they accepted a school leaving certificate (he spent a couple of yrs in school here) from my cousin as evidence he is of indian origin. I think the south is kind of lax or just less suspicious. They do send an intelligence type over who enquires about you all over the place though lol |

More stuff Indian Nationals on their return from abroad can take up employment, business or profession in India without any reference to RBI. With amendment to FERA, 1973, persons of Indian Origin do not require any permission from RBO for taking up employment in India. Foreign Nationals of Indian Origin permanently resident in India have been granted general exemption from the requirements of Section 28(I) and 29(ii) of FERA, 1973 vide RBI notification no- FERA- 146/93-RB DT. 26th April 1993. Accordingly, no permission of RBI is required in the following cases. (i) For acting or accepting appointment as agent of any person or company in the trading or commercial transactions of such person or company. (ii) To carry on in India any activity of trading, commercial or industrial nature or to establish a place of business in India for carrying on such activities. (iii) For acquiring the whole or any part of any undertaking in India of any person or company carrying on any trade, commerce or industry. (iv) For purchasing shares in India of any company carrying on any trade, commerce or industry. It will be observed from above discussion that foreign nationals of Indian Origin not permanently resident in India will not be exempted from the operations of Sections 28(i) and 29(ii) and will accordingly require necessary permission from RBI. |
