Having today visited the Income Tax Office to obtain an Income Tax Clearance Certificate for my wife to travel overseas as we are presently here on Business Visas, we had an interesting discussion with a thoroughly nice person.

The result of the discussion was that, he said that we did not require a Clearance Certificate as they have been abolished but gave us one anyway for peace of mind. He also gave us a copy of the notice to keep on hand should we require it.

To: All Cheif Commissioners of Income-tax, All Directors General of Income-tax.

Subject: Abolition of the scheme of obtaining Income Tax Clearance Certificate (ITCC) applicable to persons leaving India and those obtaining commercial contracts.

The undersigned is directed to bring to your notice that it has been decided with effect from January 1st 2003:-

- There shall be no requirement of furnishing Income Tax Clearance Certificates by the persons before leaving India; and

- No Income Tax Clearance Certificate shall be required to be furnished by any person while filing a tender for the purpose of obtaining commercial contracts, etc.

Accordingly, henceforth, no person leaving India by land, sea or air will be required to obtain a tax clearance certificate to furnish to airlines, etc. except in cases of persons concerning whom the Income-tax Authorities specifically notify the immigration/customs authorities asking that such persons should not be allowed to leave India without obtaining an Income Tax Clearance Certificate.

Similarly, contractors shall not be required to get Income Tax Clearance Certificate from the Income-tax Department as there will be no need to furnish such certificates while submitting tenders to Government Departments.

It is requested that the above decisions may be brought to the notice of all concerned within your jurisdiction.

Hi

Guys

I arrived in India on the 25/7/06 and will be leaving on the 02/07/07, l'm a little confused about this Income Tax Clearance Certificate, maybe l'm just abit slow(l'll blame it on the weather!)! But l was informed that if l'm here for over 6mths than l do need the certificate? I have a contact telephone number 011 23379161 but it must of changed and l can't find an updated number. I'm here on a student visa and financed the trip myself and opened an ICCI a/c in the uk with all my funds and so l don't have any encashment certificates! So my questions is, do the new rules apply to students or only to those involved in business?

End of an era if so. I still recall meeting the author of my Marathi textbook at the income tax office struggling with the system..

Tax Clearance Certificate

I went to the ITO in 2005 to get a tax certificate only to be told that it had been abolished and no certificate was required.

I was given a letter for assurance but was never asked to produce it.

Tax certs not required anymore.

I have following query for an Indian Citizen:
If traveling overseas (outside India by and Indian) for employment is there any necessity of income tax clearance certificate.
If, yes, then how to obtain it.
