Getting India Police Clearance Certificate

Hello,

after sometime, i visited again this valuable forum. By the way my assignment is finished and i return to Germany again.
We plan to move to Australia. Our application for permanent residence is on process. We have been asked to provide Indian Police Clearance Certificate.
I have to contacted the indian consulate in Germany, but the process is taking longer time and i don't know how long it will last.
Would it be possible to ask an agent (some relocation agent), to help to apply inside India? If yes, do you know which agent who can handle it? How long is the processing time?
The Indian PCC should come from Passport Office. Anybody of you can help me?

I had to get one of these in Mumbai. I had to attend in person, and it took around 1 month to process. Advise you to stick with the consulate.

As i said before, i have contacted indian consulate, but they refused since i am not indian citizen. That's why i am looking for immigration specialist who can do it for me. Perhaps you know someone in delhi?

I have exactly the same problem as you have. I am a Dutch national citizen and I am applying for Spous visa, because my wife is an Australian permanent resident.
The problem is the following. I have resided in Hyderabad for 11 months and 4 days, but I have been in India (on a business visa) for more than 12 months. The migration form clearly states that if you have been a resident of any country more than 12 months you need to submit a PCC, so for me this would be not applicable. However, my case manager informed me 30 minutes ago that the form is incorrect and that I do need to submit a PCC, because I have been in India more than 12 months (regardless of the fact that I was only visiting on a business visa)!
Even more problematic: I have found a very good career opportunity with a large bank in Sydney, but I can only join if I can start on 19-May! So this would not only mean that I hacve to reschedule/cancel tickets, but also might loose a perfect job. So I'm a bit pissed-off at the moment...

Anyway, I called up the Indian embassy and they also told me to go to Hyderabad and obtain a PCC there. The only escape that we might have, is to make clear to the Aus Embassy that "we have done everything we could do" in order to obtain it, but that we can't succeed without going to India. I think they might accept it as a special case in which PCC cannot be submitted.

Any other good ideas? What is the "official" procedure?

Obtaining Indian pcc is really painful, my circumstances are different but i finally got it. In the process, I searched a lot on the web, and found the following information which could be useful to you.

Basically, the US immigration has stated that Indian police certificates are not available for foreign (non-Indian) applicants applying outside India. This could be used to tell Australian authorities that you are not able to obtain the indian pcc.

Indian Police Clearance Certificates should be obtained as follows:

All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance.

Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.

Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.

Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.

Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.

Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.



let me know if this is helpful in your case. in future, should i apply to Australia, i know that i can then use this approach.

if you are foreigner & still resident in India, the process is to go to the Ministry of Home Affairs (MHA) in the state (eg for maharashtra, it is in mumbai), then the city regional police hq, then the local police stn, & then back to city regional police hq & then back to the MHA. it is a very painful experience that can take a long time (3 months)with multiple visits to the station / MHA.

if you are foreigner & now living outside of India, the approach would be to go to the indian high comm, and ask them to prepare a letter. there seems to be no standards over here. in some countries, the indian high comm will issue the letter within 1-2 weeks (i doubt if they do any check in India), and i am reading that in some countries, they simply don't entertain such requests !

if you are unlucky and the indian high comm in your country will not provide such a letter, best bet is to tell the australian authorities that it is not obtainable, citing the US immigration statement provided earlier.

parallelly write to the MHA in Delhi & see how quickly they provide. you should inform australia that you have written but process could take very long to no reply at all; and request for a waiver. if you were working in a large company in india, you could support your application by providing a company letter that says you were working continuously through that period without any break (& hence implying no prison; & if they are willing to write that "in our records, there are no criminal records" etc, it would be better still)

Hi, I was wondering if anybody could please help me...

I am native of India but I acquired the citizenship of another country. I later realized that this action would automatically cease my Indian citizenship. This happened several years ago, and now I cannot find my Indian passport, I guess I either misplaced it or even lost my Indian passport.

I am wondering, in my situation, is it possible to obtain the PCC from India? If so, what is the procedure to obtain PCC from from India?

I am having a tough time obtaining police clearance certificate from India for my wife - an Indian born, now a Kenyan national (been living in Kenya from the age of 6). She completed her studies in Karnataka, India this February. We had applied for the Police clearance from the local FRRO office who had submitted our application to the home office in Bangalore. We then got back to my home in Sri Lanka. It took me over 3 months to get the police clearance certificate - which I submitted adding it to my application which is already being processed.

Today, I got a bombshell - I got a reply from my case officer saying that the police clearance certificate has been issued by the invalid authority (issued by the government of Karnataka) and it should be issued from Delhi!!! and even worse is that the last date of submission is end June (I already asked for 2 extensions) Now, I am clueless as to what I have to do - If I am to go Delhi, both me and my wife will have to leave our jobs (as we cannot get holidays on such short notice)... any advise???

Why it should be issued from Delhiasin last post!!! Is it because the passport is from Delhi !

Hi frakanwai,

Well, form 47P states that those who are non-residents (other nationals) need to get the police clearance from New Delhi Home Office.

However, I approached the Indian High commission in my country with the police clearance which I had already received (My mom is an Indian citizen so it was easy to get through to them). They took a small charge, and few weeks later I called up and the PCC was ready which was accepted by the Immigration Department.

Well, my wife and I also received my letter of Visa grant.
