Thumbs up Dual Citizenship in India

Quote:
Dual Citizenship in India

It is possible for someone to be considered a citizen under the laws of two or more countries at the same time. This is known as dual citizenship. The Indian Parliament passed a Bill to grant dual citizenship to the people of Indian origin on December 22, 2003. The Bill received the President's approval on January 7, 2004, and became operational from 2nd December 2005. The Bill will help grant dual citizenship to Persons of Indian Origin (PIOs) belonging to, or having citizenship of other countries subject to certain conditions. The grant of dual citizenship was intended to remove for those who have taken foreign passports, the obstacle in travel to and from India, permit investment in business ventures and foster a greater sense of belonging.

The Overseas citizenship of India (OCI) commonly known as dual citizenship is granted to persons who migrated from India and acquired citizenship of a foreign country other than Pakistan and Bangladesh. They are eligible for grant of OCI as long as their home countries allow dual citizenship in some form or the other under their local laws. However persons registered as OCI shall not have any voting rights and rights for public employment.

I would strongly advise using Indian Government (Ministry of Home Affairs, and/or your local embassy or consulate site) as the main source of reference for this kind of stuff. Even then, not all officials will agree!

I think this article is misleading. India does not offer dual citizenship. If an Indian national takes up the citizenship of another country then his Indinal citizenship stands cancelled automatically, in practice one might need to inform the local embassy.
OCI is commonly refered to as dual citizenship but never in offical communication. It is more of a slang than actual granting of rights.
The statement "They are eligible for grant of OCI as long as their home countries allow dual citizenship" is also wrong as getting OCI does not get an Indian passport or travel document, merely a certificate (which is size of a passport).

There have been a few posts stating this before.

Nick is right only the official government sites should be quoted.

I agree. It is my understanding that India does not allow an Indian citizen to also have citizenship of another country, and requires that a citizen of another country should renounce that citizenship if they take up Indian citizenship.

OCI was a rather unfortunate choice of terminology!

But it is always interesting to read interpretations from others.
