Business Visa Letter from Indian Business partner.

Hello All

Wondering if anyone can help me I'm trying to draft a letter for the UK Indian Embassy that will wow them into giving me a Business visa for an Indian partnership not just for business trips to India.

Anyone had such letter or got any idea what should and shouldn't be said. Business plan for hotel and restaurant.

The letter will be from my proposed business partner who already has many businesses.

I don't think the consulate has any authority to permit you to open up a business in India. That is probably controlled by some other govt agency in India. All they can do is give you a visa that allows you to visit India. If you are in Agra, you should look into opening up the business, then you can use that to obtain future business visas

Cheers for that I think your right but I'm in a bit of a catch 22 as my current Business Visa doesn't allow me to open a business as I work for an Australian company. I don't think you can start a business on a Tourist visa either.

The law was changed about one year ago and now foreigners are allowed to set up an Indian company without the need to have an Indian partner.

Things are changing fast in India and so some advice may be outdated. I strongly suggest you obtain an Indian law firm that also has offices in the UK (or vice versa). This will give you control over the whole situation whether you are in India or in the UK> Such firms are also professional and realiable.

I did that in the US and trust me it was worth the money I spent.

Your current visa status has no bearing on whether you can start a business. You can start one even without a visa.

I have a friend who is on a 2 year business visa and he told me you need to leave the country and apply at the indian consulate from your country of origin.

This guy has a big buisness in the UK and plans to build a resort in Goa. He is not working for anyone but himself..currently in the UK, he is here for about 6-9 months in a year .

Easy

I am currently here on a business visa where i am setting up a JV with an indian company. A simple letter from your proposed business partner (who i assume is an indian company) will suffice ..together of course with all the other docs.. then you can get a 6 month business visa.(make sure its a multiple re-entry visa if during that time you need to travel abroad). make sure you arent gettin paid in india while on a business visa. When the business is finalized, you can then apply for a work permit, again submitting all the usual docs. Let me know if you need more info

I assume from your question that you are referring to the setting up of a branch/representative/liason office and NOT a Joint Venture as mentioned by Jeff_hill8.

To set up a branch/representative/liason office you have to take permission from the Reserve Bank of India which is called the RBI. Permission for setting up branch offices is granted by the Reserve Bank of India (RBI) on a case to case basis. RBI normally considers the operating history of the applicant company worldwide and its proposed activities in India before granting the approval.

To open a branch office you need to fill Form FNC 4 available here http://www.rbi.org.in/sec22/FNC4.DOC

To open up a liaison office in India or to post a representative in India for undertaking liaison activities on behalf of the parent company you need to fill this Form FNC 5 available here http://www.rbi.org.in/sec22/FNC5.DOC

it really IS a catch 22 to set up shop in india...
To get a business visa you need a sponsor from an indian company? HELLOOOO I wan't to CREATE my company so it does not exist yet...
What's the solution? And the tourist visa application form has you sign an agreement NOT TO SET UP A BUSINESS in India.... Heeeelp

If you have a Business Visa you do not require a work permit as the BV covers both, if you are doing business you are working and you are always earning. That is what the embassy in NZ told me so go with that.

Only some types of businesses are open to foreigners to register without Indian partners. IT and education are flexible but may require an Indian director on the board as the minimal requirement. 100% ownership as in 100% shareholding is permitted under IT and education.

Plan to open a business, go on a tourist visa and do your research, make contacts and get a letter of Joint Venture Interest from someone that is already in business. Letter heads of Indian companies are essential for an easy visa. Once you get the Business Visa, return and be prepared to be stuffed about for6 to 12 months beforew you get your final registrations complete and can actually run a business. However there is not much to stop you quietly doing business if all of the funds stay in India and you have a low profile. One can register as a sole trader and be free of many hassles.
