Talking Software sold by kilos

Yesterdays ‘The Hindu’ carried an unusual (not unexpected though) advertisement. The advertiser (forgot their name) sells software CDs by weight in their shop in Bangalore.

The going rate is Rs160 per 100 grams of CDs.

I saw the entire Microsoft .Net suite for under 2000rs. It came with an "authentic" black&white xerox of the licensing codes.

Will software deemed illegal be confiscated when you return to country of origin? In my case the states.

Not that I'd buy any, I'm doing a school report on Indian software's affect on Bill Gates

Doubt it.

I know people who come back from Thailand with many pirated DVDs, watches etc and they have never had a problem.

I've had friends travelling around with a lot of privately copied CD's, nothing illegal about it, having them all confiscated. It's then up to you to make a case that those 30 CD's were really all for private use. Internationally they seem to be stepping up against illegally copied goods of all kinds ("designer" clothes and stuff), I'm sure it goes by "temporary extra attention" actions & depends on how much you bring & the customer's mood of the day.

I had purchased some DVD's and VCD's from India and when I returned to Vancouver the customs officer closely examined each one. Fortunately each one was original and not pirated.

Expecting Rs. 10,000 or more for a software is foolishness from a company's perspective especially in India. $100 to $200 in US or Uk or other first world countries is not that bad or as expensive as Rs.10,000 looks like for a CD. But I am sure thats equally expensive as well to the people in those places.

Coming to games - most original CD's cost Rs 1000 - 2000. Don't expect any parent to shell out that kind of money on a game CD for a kid. Hence it just won't sell. Well now if the cost of the .Net software was around Rs 1000 - 2000 then it would have a good chance of selling. When it comes to games make it Rs 100 - 300 and maximum of Rs 500. Yes, most local companies which made games sell at that price.

Hence these things happen in India.

Disclaimer - I am not a lawyer and this is just my understanding

And it is illegal to make a copy of a CD for private use unless you have the original and is solely meant as a backup in case something happenes to the original. In addition to that if you break copy protection of a DVD and copy a DVD although you own the original is also illegal. So in essence I don't think you can make a copy of DVD for private or personal use although I am not sure how the law holds here. Thank the DMCA for that though.
For more answers(i.e. if you need them) read the EULA(end users license agreement) of the CD and ask a lawyer.
